1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Asthma
5 Inhalers at Recreational Camps Act.
 
6     Section 5. Definitions. In this Act:
7     "Recreational camp" means any place set apart for
8 recreational purposes for boys and girls. "Recreational camp"
9 shall not apply to private camps owned or leased for individual
10 or family use, or to any camp operated for a period of less
11 than 10 days in a year.
 
12     Section 10. Possession, self-administration, and use of
13 epinephrine auto-injectors or inhalers at recreation camps.
14     (a) A recreation camp shall permit a child with severe,
15 potentially life-threatening allergies to possess,
16 self-administer, and use an epinephrine auto-injector or
17 inhaler, if the following conditions are satisfied:
18         (1) The child has the written approval of his or her
19     parent or guardian.
20         (2) The recreational camp administrator or, if a nurse
21     is assigned to the camp, the nurse shall receive copies of
22     the written approvals required under paragraph (1) of
23     subsection (a) of this Section.
24         (3) The child's parent or guardian shall submit written
25     verification confirming that the child has the knowledge
26     and skills to safely possess, self-administer, and use an
27     epinephrine auto-injector or inhaler in a camp setting.
28     (b) The child's parent or guardian shall provide the camp
29 with the following information:
30         (1) the child's name;
31         (2) the name, route, and dosage of medication;

1         (3) the frequency and time of medication
2     administration or assistance;
3         (4) the date of the order;
4         (5) a diagnosis and any other medical conditions
5     requiring medications, if not a violation of
6     confidentiality or if not contrary to the request of the
7     parent or guardian to keep confidential;
8         (6) specific recommendations for administration;
9         (7) any special side effects, contraindications, and
10     adverse reactions to be observed;
11         (8) the name of each required medication; and
12         (9) any severe adverse reactions that may occur to
13     another child, for whom the epinephrine auto-injector or
14     inhaler is not prescribed, should the other child receive a
15     dose of the medication.
16     (c) If the conditions of this Act are satisfied, the child
17 may possess, self-administer, and use an epinephrine
18 auto-injector or inhaler at the camp or at any camp-sponsored
19 activity, event, or program.
20     (d) The recreational camp must inform the parents or
21 guardians of the child, in writing, that the recreational camp
22 and its employees and agents are to incur no liability, except
23 for willful and wanton conduct, as a result of any injury
24 arising from the self-administration of medication to the
25 child. The parents or guardians of the child must sign a
26 statement acknowledging that the recreational camp is to incur
27 no liability, except for willful and wanton conduct, as a
28 result of any injury arising from the self-administration of
29 medication by the child and that the parents or guardians must
30 indemnify and hold harmless the recreational camp and its
31 employees and agents against any claims, except a claim based
32 on willful and wanton conduct, arising out of the
33 self-administration of medication by the child.
 
34     Section 99. Effective date. This Act takes effect upon
35 becoming law.
