SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/13-501.7 new

    Amends the Telecommunications Article of the Public Utilities Act. Provides that, on and after September 1, 2005, no telecommunications carrier may charge to any customer a fee for withholding the customer's name, address, or telephone number from either the published telephone directory or the electronic directory assistance database, unless the Commission finds that the fee is based on the actual cost to the carrier of withholding the information. Requires a telecommunications carrier to refund to the customer any fee imposed on or after September 1, 2005 for withholding the customer's name, address, or telephone number. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by adding
5 Section 13-501.7 as follows:
 
6     (220 ILCS 5/13-501.7 new)
7     Sec. 13-501.7. Directory assistance; withholding
8 information. On and after September 1, 2005, no
9 telecommunications carrier shall charge to any customer a fee
10 for withholding the customer's name, address, or telephone
11 number from either the published telephone directory or the
12 electronic directory assistance database, unless the
13 Commission finds that the fee charged for withholding that
14 information is based on the actual cost to the company of
15 withholding the information. Any fees charged on or after
16 September 1, 2005 to a customer of a telecommunications carrier
17 for withholding the customer's name, address, or telephone
18 number shall be refunded to that customer to the extent that
19 the Commission finds that the carrier has failed to justify the
20 imposition of the fee.
 
21     Section 99. Effective date. This Act takes effect upon
22 becoming law.
