1     AN ACT concerning transportation.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 15-307 as follows:

6     (625 ILCS 5/15-307)  (from Ch. 95 1/2, par. 15-307)
7     Sec. 15-307. Fees for Overweight-Gross Loads. Fees for
8 special permits to move vehicles, combinations of vehicles and
9 loads with overweight-gross loads shall be paid at the flat
10 rate fees established in this Section for weights in excess of
11 legal gross weights, by the applicant to the Department.
12     (a) With respect to fees for overweight-gross loads listed
13 in this Section and for overweight-axle loads listed in Section
14 15-306, one fee only shall be charged, whichever is the
15 greater, but not for both.
16     (b) In lieu of the fees stated in this Section and Section
17 15-306, with respect to combinations of vehicles consisting of
18 a 3-axle truck tractor with a tandem axle composed of 2
19 consecutive axles drawing a semitrailer, or other vehicle
20 approved by the Department, equipped with a tandem axle
21 composed of 3 consecutive axles, weighing over 73,280 pounds
22 but not more than 88,000 pounds gross weight, the fees shall be
23 at the following rates:
24     Distance Rate
25 For the first 45 miles $10
26 From 45 miles to 90 miles 12.50
27 From 90 miles to 135 miles 15.00
28 From 135 miles to 180 miles 17.50
29 From 180 miles to 225 miles 20.00
30 For each additional 45 miles or part
31 thereof in excess of the rate for
32 225 miles, an additional 2.50
33     For such combinations weighing over 88,000 pounds but not
34 more than 100,000 pounds gross weight, the fees shall be at the
35 following rates:

37 For the first 45 miles 15
38 From 45 miles to 90 miles 25
39 From 90 miles to 135 miles 35
40 From 135 miles to 180 miles 45
41 From 180 miles to 225 miles 55
42 For each additional 45 miles or part
43 thereof in excess of the rate for
44 225 miles, an additional 10
45     For such combination weighing over 100,000 pounds but not
46 more than 110,000 pounds gross weight, the fees shall be at the
47 following rates:

49 For the first 45 miles $20
50 From 45 miles to 90 miles 32.50
51 From 90 miles to 135 miles 45
52 From 135 miles to 180 miles 57.50
53 From 180 miles to 225 miles 70
54 For each additional 45 miles or part
55 thereof in excess of the rate for
56 225 miles an additional 12.50
57     For such combinations weighing over 110,000 pounds but not
58 more than 120,000 pounds gross weight, the fees shall be at the
59 following rates:

61 For the first 45 miles $30
62 From 46 miles to 90 miles 55
63 From 90 miles to 135 miles 80
64 From 135 miles to 180 miles 105
65 From 180 miles to 225 miles 130
66 For each additional 45 miles or part
67 thereof in excess of the rate
68 for 225 miles an additional 25
69     Payment of overweight fees for the above combinations also
70 shall include fees for overwidth dimensions of 4 feet or less,
71 overheight and overlength. Any overwidth in excess of 4 feet
72 shall be charged an additional fee of $15.
73     (c) In lieu of the fees stated in this Section and Section
74 15-306 of this Chapter, with respect to combinations of
75 vehicles consisting of a 3-axle truck tractor with a tandem
76 axle composed of 2 consecutive axles drawing a semitrailer, or
77 other vehicle approved by the Department, equipped with a
78 tandem axle composed of 2 consecutive axles, weighing over
79 73,280 pounds but not more than 88,000 pounds gross weight, the
80 fees shall be at the following rates:

82 For the first 45 miles $20
83 From 45 miles to 90 miles 32.50
84 From 90 miles to 135 miles 45
85 From 135 miles to 180 miles 57.50
86 From 180 miles to 225 miles 70
87 For each additional 60 miles or part
88 thereof in excess of the rate for
89 225 miles an additional 12.50
90     For such combination weighing over 88,000 pounds but not
91 more than 100,000 pounds gross weight, the fees shall be at the
92 following rates:

94 For the first 45 miles $30
95 From 46 miles to 90 miles 55
96 From 90 miles to 135 miles 80
97 From 135 miles to 180 miles 105
98 From 180 miles to 225 miles 130
99 For each additional 45 miles or part
100 thereof in excess of the rate for
101 225 miles an additional 25
102     Payment of overweight fees for the above combinations also
103 shall include fees for overwidth dimension of 4 feet or less,
104 overheight and overlength. Any overwidth in excess of 4 feet
105 shall be charged an additional overwidth fee of $15.
106     (d) In lieu of the fees stated in this Section and in
107 Section 15-306 of this Chapter, with respect to a 3 (or more)
108 axle mobile crane or water well-drilling vehicle consisting of
109 a single axle and a tandem axle or 2 tandem axle groups
110 composed of 2 consecutive axles each, with a distance of
111 extreme axles not less than 18 feet, weighing not more than
112 60,000 pounds gross with no single axle weighing more than
113 21,000 pounds, or any tandem axle group to exceed 40,000
114 pounds, the fees shall be at the following rates:
115     Distance Rate
116 For the first 45 miles $12.50
117 For each additional 45 miles or portion thereof 9.00
118     For such vehicles weighing over 60,000 pounds but not more
119 than 68,000 pounds with no single axle weighing more than
120 21,000 pounds and no tandem axle group exceeding 48,000 pounds,
121 the fees shall be at the following rates:

123 For the first 45 miles $20
124 For each additional 45 miles or portion thereof 12.50
125     Payment of overweight fees for the above vehicle shall
126 include overwidth dimension of 4 feet or less, overheight and
127 overlength. Any overwidth in excess of 4 feet shall be charged
128 an additional overwidth fee of $15.
129     (e) In lieu of the fees stated in this Section and in
130 Section 15-306 of this Chapter, with respect to a 4 (or more)
131 axle mobile crane or water well drilling vehicle consisting of
132 2 sets of tandem axles composed of 2 or more consecutive axles
133 each with a distance between extreme axles of not less than 23
134 feet weighing not more than 72,000 pounds with axle weights on
135 one set of tandem axles not more than 34,000 pounds, and weight
136 in the other set of tandem axles not to exceed 40,000 pounds,
137 the fees shall be at the following rates:

139 For the first 45 miles $15
140 For each additional 45 miles or portion thereof 10
141     For such vehicles weighing over 72,000 pounds but not more
142 than 76,000 pounds with axle weights on either set of tandem
143 axles not more than 44,000 pounds, the fees shall be at the
144 following rates:

146 For the first 45 miles $20
147 For each additional 45 miles or portion thereof 12.50
148     Payment of overweight fees for the above vehicle shall
149 include overwidth dimension of 4 feet or less, overheight and
150 overlength. Any overwidth in excess of 4 feet shall be charged
151 an additional fee of $15.
152     (f) In lieu of fees stated in this Section and in Section
153 15-306 of this Chapter, with respect to a two axle mobile crane
154 or water well-drilling vehicle consisting of 2 single axles
155 weighing not more than 48,000 pounds with no single axle
156 weighing more than 25,000 pounds, the fees shall be at the
157 following rates:

159 For the first 45 miles $15
160 For each additional 45 miles or portion thereof 10
161     For such vehicles weighing over 48,000 pounds but not more
162 than 54,000 pounds with no single axle weighing more than
163 28,000 pounds, the fees shall be at the following rates:

165 For the first 45 miles $20
166 For each additional 45 miles or portion thereof 12.50
30     Payment of overweight fees for the above vehicle shall
31 include overwidth dimension of 4 feet or less, overheight and
32 overlength. Any overwidth in excess of 4 feet shall be charged
33 an additional overwidth fee of $15.
34     (g) Fees for special permits to move vehicles, combinations
35 of vehicles, and loads with overweight gross loads not included
36 in the fee categories shall be paid by the applicant to the

1 Department at the rate of $50 plus 3.5 cents per ton-mile in
2 excess of legal weight.
3     With respect to fees for overweight gross loads not
4 included in the schedules specified in paragraphs (a) through
5 (e) of Section 15-307 and for overweight axle loads listed in
6 Section 15-306, one fee only shall be charged, whichever is the
7 greater, but not both. An additional fee in accordance with the
8 schedule set forth in Section 15-305 shall be charged for each
9 overdimension.
10     (h) Fees for special permits for continuous limited
11 operation authorizing the applicant to operate vehicles that
12 exceed the weight limits provided for in subsection (d) of
13 Section 15-111.
14     All single axles excluding the steer axle and axles within
15 a tandem are limited to 24,000 pounds or less unless otherwise
16 noted in this subsection (h). Loads up to 12 feet wide and 110
17 feet in length shall be included within this permit. Fees shall
18 be $250 for a quarterly and $1,000 for an annual permit. Front
19 tag axle and double tandem trailers are not eligible.
20     The following configurations qualify for the quarterly and
21 annual permits:
22         (1) 3 or more axles, total gross weight of 68,000
23     pounds or less, front tandem or axle 21,000 pounds or less,
24     rear tandem 48,000 pounds or less on 2 or 3 axles, 25,000
25     pounds or less on single axle;
26         (2) 4 or more axles, total gross weight of 76,000
27     pounds or less, front tandem 44,000 pounds or less on 2
28     axles, front axle 20,000 pounds or less, rear tandem 44,000
29     pounds or less on 2 axles and 23,000 pounds or less on
30     single axle or 48,000 pounds or less on 3 axles, 25,000
31     pounds or less on single axle;
32         (3) 5 or more axles, total gross weight of 100,000
33     pounds or less, front tandem 48,000 pounds or less on 2
34     axles, front axle 20,000 pounds or less, 25,000 pounds or
35     less on single axle, rear tandem 48,000 pounds or less on 2
36     axles, 25,000 pounds or less on single axle;

1         (4) 6 or more axles, total gross weight of 120,000
2     pounds or less, front tandem 48,000 pounds or less on 2
3     axles, front axle 20,000 pounds or less, single axle 25,000
4     pounds or less, or rear tandem 60,000 pounds or less on 3
5     axles, 21,000 pounds or less on single axles within a
6     tandem.
