SYNOPSIS AS INTRODUCED:

Amends the School Code. Provides that each school board must adopt, no later than the 2006-2007 school year, nutritional goals and policies regarding the use of vending machines in schools. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Sections 10-20.40 and 34-18.32 as follows:

(105 ILCS 5/10-20.40 new)

Sec. 10-20.40. Vending machines. Each school board must adopt, no later than the 2006-2007 school year, nutritional goals and policies regarding the use of vending machines in schools, including without limitation getting rid of all foods and soft drinks that have little or no nutritional value in these vending machines.

The board must adopt, no later than the 2006-2007 school year, nutritional goals and policies regarding the use of vending machines in schools, including without limitation getting rid of all foods and soft drinks that have little or no nutritional value in these vending machines.

Section 90. The State Mandates Act is amended by adding Section 8.29 as follows:

Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8 of this Act, no reimbursement by the State is required for the implementation of any mandate created by this amendatory Act of the 94th General Assembly.

Section 99. Effective date. This Act takes effect upon becoming law.
