    Amends the Volunteer Firefighter Job Protection Act. Changes the short title of the Act to the Volunteer EMT and Firefighter Job Protection Act and makes corresponding changes. Makes the provisions of the Act applicable to all licensed EMT's who provide services to a unit of local government with a population of 3,500 or less. Defines "volunteer EMT" to mean a person who works without monetary compensation for a unit of local government and is licensed as an EMT under the Emergency Medical Services (EMS) Systems Act. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Volunteer Firefighter Job Protection Act is
5 amended by changing Sections 1, 3, and 5 as follows:

7     Sec. 1. Short title. This Act may be cited as the
8 Volunteer EMT and Firefighter Job Protection Act.

11     Sec. 3. Definitions. As used in this Act:
12     "Volunteer EMT" means an emergency medical technician
13 (EMT) who is licensed pursuant to the Emergency Medical
14 Services (EMS) Systems Act (210 ILCS 50/), who does not receive
15 monetary compensation for his or her services as an EMT to a
16 unit of local government, and who does not work for any other
17 unit of local government for monetary compensation.
18     "Volunteer firefighter" means a firefighter who does not
19 receive monetary compensation for his or her services to a fire
20 department or fire protection district and who does not work
21 for any other fire department or fire protection district for
22 monetary compensation.
23     "Monetary compensation" does not include a monetary
24 incentive awarded to a firefighter by the board of trustees of
25 a fire protection district under Section 6 of the Fire
26 Protection District Act.

29     Sec. 5. Volunteer EMT or volunteer firefighter; when
30 termination of employment prohibited.

1     (a) No public or private employer may terminate an employee
2 who is a volunteer EMT or a volunteer firefighter because the
3 employee, when acting as a volunteer EMT or a volunteer
4 firefighter, is absent from or late to his or her employment in
5 order to respond to an emergency prior to the time the employee
6 is to report to his or her place of employment.
7     (b) An employer may charge, against the employee's regular
8 pay, any time that an employee who is a volunteer EMT or a
9 volunteer firefighter loses from employment because of the
10 employee's response to an emergency in the course of performing
11 his or her duties as a volunteer EMT or a volunteer
12 firefighter.
13     (c) In the case of an employee who is a volunteer EMT or a
14 volunteer firefighter and who loses time from his or her
15 employment in order to respond to an emergency in the course of
16 performing his or her duties as a volunteer EMT or a volunteer
17 firefighter, the employer has the right to request the employee
18 to provide the employer with a written statement from the
19 supervisor or acting supervisor of the volunteer EMT or the
20 volunteer firefighter fire department stating that the
21 employee responded to an emergency and stating the time and
22 date of the emergency.
23     (d) An employee who is a volunteer EMT or a volunteer
24 firefighter and who may be absent from or late to his or her
25 employment in order to respond to an emergency in the course of
26 performing his or her duties as a volunteer EMT or a volunteer
27 firefighter must make a reasonable effort to notify his or her
28 employer that he or she may be absent or late.
