    Amends the Children's Privacy Protection and Parental Empowerment Act. Makes a technical change in a Section concerning information brokers.

1     AN ACT concerning children.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Children's Privacy Protection and Parental
5 Empowerment Act is amended by changing Section 15 as follows:
 
6     (325 ILCS 17/15)
7     Sec. 15. Information brokers.
8     (a) For the the purpose of this Act, the consent of a
9 parent to the sale or purchase of information concerning a
10 child is presumed unless the parent withdraws consent under
11 this Section.
12     A person who brokers or facilitates the sale of personal
13 information concerning children must, upon written request
14 from a parent that specifically identifies the child, provide
15 to the parent within 20 days of the written request procedures
16 that the parent must follow in order to withdraw consent to use
17 personal information relating to that child. The person who
18 brokers or facilitates the sale of personal information must
19 discontinue disclosing a child's personal information within
20 20 days after the parent has completed the procedures to
21 withdraw consent to use personal information relating to that
22 child.
23     (b) This Section does not apply to any of the following:
24         (1) Any federal, state, or local government agency or
25     any law enforcement agency.
26         (2) The National Center for Missing and Exploited
27     Children.
28         (3) Any educational institution, consortium,
29     organization, or professional association, including but
30     not limited to, public community colleges, public
31     universities, post-secondary educational institutions as
32     defined in the Private College Act, and private business

1     and vocational schools as defined in the Private Business
2     and Vocational Schools Act.
3         (4) Any not-for-profit entity that is exempt from the
4     payment of federal taxes under Section 501(c)(3) of the
5     Internal Revenue Code of 1986.
