1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 the heading of Article VI of Chapter 3 and Sections 3-412 and
6 12-503 and adding Section 3-663 as follows:
 
7     (625 ILCS 5/3-412)  (from Ch. 95 1/2, par. 3-412)
8     Sec. 3-412. Registration plates and registration stickers
9 to be furnished by the Secretary of State.
10     (a) The Secretary of State upon registering a vehicle
11 subject to annual registration for the first time shall issue
12 or shall cause to be issued to the owner one registration plate
13 for a motorcycle, trailer, semitrailer, motorized pedalcycle
14 or truck-tractor, 2 registration plates for other motor
15 vehicles and, where applicable, current registration stickers
16 for motor vehicles of the first division. The provisions of
17 this Section may be made applicable to such vehicles of the
18 second division, as the Secretary of State may, from time to
19 time, in his discretion designate. On subsequent annual
20 registrations during the term of the registration plate as
21 provided in Section 3-414.1, the Secretary shall issue or cause
22 to be issued registration stickers as evidence of current
23 registration. However, the issuance of annual registration
24 stickers to vehicles registered under the provisions of
25 Sections 3-402.1 and 3-405.3 of this Code may not be required
26 if the Secretary deems the issuance unnecessary.
27     (b) Every registration plate shall have displayed upon it
28 the registration number assigned to the vehicle for which it is
29 issued, the name of this State, which may be abbreviated, the
30 year number for which it was issued, which may be abbreviated,
31 the phrase "Land of Lincoln" (except as otherwise provided in
32 this Code Chapter 3), and such other letters or numbers as the

1 Secretary may prescribe. However, for apportionment plates
2 issued to vehicles registered under Section 3-402.1 and fleet
3 plates issued to vehicles registered under Section 3-405.3, the
4 phrase "Land of Lincoln" may be omitted to allow for the word
5 "apportioned", the word "fleet", or other similar language to
6 be displayed. Registration plates issued to a vehicle
7 registered as a fleet vehicle may display a designation
8 determined by the Secretary.
9     The Secretary may in his discretion prescribe that letters
10 be used as prefixes only on registration plates issued to
11 vehicles of the first division which are registered under this
12 Code and only as suffixes on registration plates issued to
13 other vehicles. Every registration sticker issued as evidence
14 of current registration shall designate the year number for
15 which it is issued and such other letters or numbers as the
16 Secretary may prescribe and shall be of a contrasting color
17 with the registration plates and registration stickers of the
18 previous year.
19     (c) Each registration plate and the required letters and
20 numerals thereon, except the year number for which issued,
21 shall be of sufficient size to be plainly readable from a
22 distance of 100 feet during daylight, and shall be coated with
23 reflectorizing material. The dimensions of the plate issued to
24 vehicles of the first division shall be 6 by 12 inches.
25     (d) The Secretary of State shall issue for every passenger
26 motor vehicle rented without a driver the same type of
27 registration plates as the type of plates issued for a private
28 passenger vehicle.
29     (e) The Secretary of State shall issue for every passenger
30 car used as a taxicab or livery, distinctive registration
31 plates.
32     (f) The Secretary of State shall issue for every motorcycle
33 distinctive registration plates distinguishing between
34 motorcycles having 150 or more cubic centimeters piston
35 displacement, or having less than 150 cubic centimeter piston
36 displacement.

1     (g) Registration plates issued to vehicles for-hire may
2 display a designation as determined by the Secretary that such
3 vehicles are for-hire.
4     (h) The Secretary of State shall issue for each electric
5 vehicle distinctive registration plates which shall
6 distinguish between electric vehicles having a maximum
7 operating speed of 45 miles per hour or more and those having a
8 maximum operating speed of less than 45 miles per hour.
9     (i) The Secretary of State shall issue for every public and
10 private ambulance registration plates identifying the vehicle
11 as an ambulance. The Secretary shall forward to the Department
12 of Public Aid registration information for the purpose of
13 verification of claims filed with the Department by ambulance
14 owners for payment for services to public assistance
15 recipients.
16     (j) The Secretary of State shall issue for every public and
17 private medical carrier or rescue vehicle livery registration
18 plates displaying numbers within ranges of numbers reserved
19 respectively for medical carriers and rescue vehicles. The
20 Secretary shall forward to the Department of Public Aid
21 registration information for the purpose of verification of
22 claims filed with the Department by owners of medical carriers
23 or rescue vehicles for payment for services to public
24 assistance recipients.
25     (k) The Secretary of State shall issue distinctive license
26 plates or distinctive license plate stickers for every vehicle
27 exempted from subsection (a) of Section 12-503 by subsection
28 (g-5) of that Section.

1 plate stickers. The Secretary, upon receipt of an application
2 made in the form prescribed by the Secretary, shall issue
3 special registration plates or plate stickers designated as
4 Medically Required Tinted Window license plates or plate
5 stickers. The special plates or plate stickers issued under
6 this Section shall be affixed only to passenger vehicles of the
7 first division or their license plates and to motor vehicles of
8 the second division weighing not more than 8,000 pounds or
9 their license plates. Plates issued under this Section shall
10 expire according to the multi-year procedure established by
11 Section 3-414.1 of this Code. Plate stickers issued under this
12 Section shall expire in accordance with rules adopted by the
13 Secretary. The design and color of the plates or plate stickers
14 shall be wholly within the discretion of the Secretary of
15 State.

17     Sec. 12-503. Windshields must be unobstructed and equipped
18 with wipers.
19     (a) No person shall drive a motor vehicle with any sign,
20 poster, window application, reflective material, nonreflective
21 material or tinted film upon the front windshield, sidewings or
22 side windows immediately adjacent to each side of the driver. A
23 nonreflective tinted film may be used along the uppermost
24 portion of the windshield if such material does not extend more
25 than 6 inches down from the top of the windshield. Nothing in
26 this Section shall create a cause of action on behalf of a
27 buyer against a dealer or manufacturer who sells a motor
28 vehicle with a window which is in violation of this Section.
29     (b) Nothing contained in this Section shall prohibit the
30 use of nonreflective, smoked or tinted glass, nonreflective
31 film, perforated window screen or other decorative window
32 application on windows to the rear of the driver's seat, except
33 that any motor vehicle with a window to the rear of the
34 driver's seat treated in this manner shall be equipped with a
35 side mirror on each side of the motor vehicle which are in

1 conformance with Section 12-502.
2     (c) No person shall drive a motor vehicle with any objects
3 placed or suspended between the driver and the front
4 windshield, rear window, side wings or side windows immediately
5 adjacent to each side of the driver which materially obstructs
6 the driver's view.
7     (d) Every motor vehicle, except motorcycles, shall be
8 equipped with a device, controlled by the driver, for cleaning
9 rain, snow, moisture or other obstructions from the windshield;
10 and no person shall drive a motor vehicle with snow, ice,
11 moisture or other material on any of the windows or mirrors,
12 which materially obstructs the driver's clear view of the
13 highway.
14     (e) No person shall drive a motor vehicle when the
15 windshield, side or rear windows are in such defective
16 condition or repair as to materially impair the driver's view
17 to the front, side or rear. A vehicle equipped with a side
18 mirror on each side of the vehicle which are in conformance
19 with Section 12-502 will be deemed to be in compliance in the
20 event the rear window of the vehicle is materially obscured.
21     (f) Paragraphs (a) and (b) of this Section shall not apply
22 to:
23         (1) motor vehicles manufactured prior to January 1,
24     1982; or
25         (2) to those motor vehicles properly registered in
26     another jurisdiction.
27     (g) Paragraph (a) of this Section shall not apply to any
28 motor vehicle with a window treatment, including but not
29 limited to a window application, reflective material,
30 nonreflective material, or tinted film, applied or affixed to
31 the motor vehicle for the purposes set forth in item (1) or (2)
32 before the effective date of this amendatory Act of 1997 and:
33         (1) that is owned and operated by a person afflicted
34     with or suffering from a medical illness, ailment, or
35     disease which would require that person to be shielded from
36     the direct rays of the sun; or

1         (2) that is used in transporting a person when the
2     person resides at the same address as the registered owner
3     of the vehicle and the person is afflicted with or
4     suffering from a medical illness, ailment or disease which
5     would require the person to be shielded from the direct
6     rays of the sun;
7         It must be certified by a physician licensed to
8     practice medicine in Illinois that such person owning and
9     operating or being transported in a motor vehicle is
10     afflicted with or suffers from such illness, ailment, or
11     disease and such certification must be carried in the motor
12     vehicle at all times. The certification shall be legible
13     and shall contain the date of issuance, the name, address
14     and signature of the attending physician, and the name,
15     address, and medical condition of the person requiring
16     exemption. The information on the certificate for a window
17     treatment applied or affixed before the effective date of
18     this amendatory Act of 1997 must remain current and shall
19     be renewed annually by the attending physician, but in no
20     event shall a certificate issued for purposes of this
21     subsection be valid on or after January 1, 2008. The person
22     shall also submit a copy of the certification to the
23     Secretary of State. The Secretary of State may forward
24     notice of certification to law enforcement agencies.
25     This subsection shall not be construed to authorize window
26 treatments applied or affixed on or after the effective date of
27 this amendatory Act of 1997.
28     The exemption provided by this subsection (g) shall not
29 apply to any motor vehicle on and after January 1, 2008.
30     This subsection (g) does not apply to the exemption set
31 forth in subsection (g-5).
32     (g-5) Paragraph (a) of this Section does not apply to any
33 motor vehicle with a window treatment, including but not
34 limited to a window application, reflective material,
35 nonreflective material, or tinted film, applied or affixed to a
36 motor vehicle that:

1         (i) is owned and operated by a person afflicted with or
2     suffering from systemic or discoid lupus erythematosus or
3     albinism; or
4         (ii) is used in transporting a person who resides at
5     the same address as the registered owner and is afflicted
6     with or suffers from systemic or discoid lupus
7     erythematosus or albinism.
8     It must be certified by a physician licensed to practice
9 medicine in Illinois that the person owning and operating or
10 being transported in a motor vehicle is afflicted with or
11 suffers from systemic or discoid lupus erythematosus or
12 albinism and the certification must be carried in the motor
13 vehicle at all times. The certification shall be legible and
14 shall contain the date of issuance, the name, address, and
15 signature of the attending physician, and the name, address,
16 and medical condition of the person requiring exemption. The
17 information on the certificate for a window treatment must
18 remain current and shall be renewed annually by the attending
19 physician. The owner of the vehicle shall also submit a copy of
20 the certification to the Secretary of State. The Secretary of
21 State may forward notice of certification to law enforcement
22 agencies.
23     (h) Paragraph (a) of this Section shall not apply to motor
24 vehicle stickers or other certificates issued by State or local
25 authorities which are required to be displayed upon motor
26 vehicle windows to evidence compliance with requirements
27 concerning motor vehicles.
28     (i) Those motor vehicles exempted under paragraph (f)(1) of
29 this Section shall not cause their windows to be treated as
30 described in paragraph (a) after January 1, 1993.
31     (j) A person found guilty of violating paragraphs (a), (b),
32 or (i) of this Section shall be guilty of a petty offense and
33 fined no less than $50 nor more than $500. A second or
34 subsequent violation of paragraphs (a), (b), or (i) of this
35 Section shall be treated as a Class C misdemeanor and the
36 violator fined no less than $100 nor more than $500. Any person

1 convicted under paragraphs (a), (b), or (i) of this Section
2 shall be ordered to alter any nonconforming windows into
3 compliance with this Section.

5     Section 99. Effective date. This Act takes effect upon
6 becoming law.
