AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Clean Indoor Air Act is amended by adding Section 4.5 as follows:

(410 ILCS 80/4.5 new)

Sec. 4.5. Non-smoking area; hospitals and nursing homes. No person shall smoke in an area immediately outside the vicinity of a hospital or nursing home if that area of the hospital or nursing home has been established as a non-smoking area by the State or unit of local government, or by a proprietor and his or her agents in control of the hospital or nursing home. For purposes of this Section, "vicinity" means the surrounding area of a place up to 30 feet away from the entrance.
