Amends the Private Detective, Private Alarm, Private Security, and
Locksmith Act of 2004. Removes the requirement that a licensee shall permit his or her office facilities and registered employee files to be audited or inspected upon 24 hours notice by the Department of Financial and Professional Regulation. Makes changes concerning the Department's subpoena power. Effective immediately.

| AN ACT concerning professional regulation.

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Private Detective, Private Alarm, Private |
| 5 |
| Security, and
Locksmith Act of 2004 is amended by changing |
| 6 |
| Sections 35-10 and 45-55 as follows:
|

| Sec. 35-10. Inspection of facilities. Each licensee shall
|
| 10 |
| permit his or her office facilities and registered employee
|
| 11 |
| files to be audited or inspected at reasonable times and in a
|
| 12 |
| reasonable manner upon 24 hours notice by the Department.

| Sec. 45-55. Subpoenas.
|
| 17 |
| (a) The Department may subpoena and bring before it any
|
| 18 |
| person to take the testimony at a hearing or by deposition and |
| 19 |
| any books and papers not clearly irrelevant to the hearing or |
| 20 |
| investigation with the same fees and in the
same manner as |
| 21 |
| prescribed in civil cases.
|
| 22 |
| (b) Any circuit court, upon the application of the
|
| 23 |
| licensee, the Department, or the Board, may order
the
|
| 24 |
| attendance of witnesses and the production of relevant books
|
| 25 |
| and papers before the Board in any hearing under this Act.
The
|
| 26 |
| circuit court may compel obedience to its order by proceedings
|
| 27 |
| for contempt.
|
| 28 |
| (c) The Director, the hearing officer or a certified
|
| 29 |
| shorthand court reporter may administer oaths at any hearing
|
| 30 |
| the Department conducts. Notwithstanding any other statute or
|
| 31 |
| Department rule to the contrary, all requests for testimony,
