SYNOPSIS AS INTRODUCED:
 
15 ILCS 405/13   from Ch. 15, par. 213

    Amends the State Comptroller Act. Provides that the State Comptroller, in paying certain State employees, shall provide for Secretary of State, Comptroller, Treasurer, Attorney General, and State Board of Education employees who are not subject to the jurisdiction of the Department of Central Management Services and who work a fractional part of a pay period to receive the amount of their normal semi-monthly pay check minus the annualized value of the days or hours missed (now, these employees receive the amount of their normal semi-monthly pay check minus the percentage of that semi-monthly check that they missed). Effective July 1, 2005.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Comptroller Act is amended by changing
5 Section 13 as follows:
 
6     (15 ILCS 405/13)  (from Ch. 15, par. 213)
7     Sec. 13. Payment of salaries of State employees - Schedule.
8 The comptroller shall prepare a schedule showing the dates on
9 which all employees of the State shall be paid. All employees
10 shall be paid at least semi-monthly, except that employees of
11 the University of Illinois, Chicago State University, Eastern
12 Illinois University, Governors State University, Illinois
13 State University, Northeastern Illinois University, Northern
14 Illinois University, Western Illinois University, and Southern
15 Illinois University who are not subject to the State
16 Universities Civil Service System shall be paid at least once
17 each month. No payment shall be made before the completion of
18 the period for which the compensation is being paid, except
19 that employees leaving the service of the State may be paid at
20 the termination of their period of employment.
21     Such schedule shall be prepared showing such dates of
22 payment so as to provide as far as is practical, an even flow
23 of work for issuance of warrants in payment of personal
24 services.
25     In making payments for a fractional part of a pay period,
26 that part of the regular compensation for the period shall be
27 paid represented by a fraction, the numerator being the number
28 of days worked and the denominator being the number of work
29 days in the period. However, in making payments for a
30 fractional part of a pay period for Secretary of State,
31 Comptroller, Treasurer, Attorney General, and State Board of
32 Education employees not subject to the jurisdiction of the

1 Department of Central Management Services who work full time or
2 a regular part of a full time schedule and who work less than
3 the total number of days or hours in a specific pay period due
4 to furlough days or hours or other noncompensated days or
5 hours, these employees shall have the value of the days or
6 hours missed derived by dividing the annualized rate of pay by
7 the total number of days or hours in the work year, with the
8 value of the days or hours missed subtracted from the
9 semimonthly amount. In However, in making payments for a
10 fractional part of a pay period for positions subject to the
11 jurisdiction of the Department of Central Management Services,
12 that part of the regular compensation shall be paid by
13 deducting an amount determined by multiplying the number of
14 work days without pay by the applicable daily rate as defined
15 within the Department of Central Management Services Pay Plan.
16     In employments of a teaching or professional nature in
17 connection with the educational, charitable, penal or
18 reformatory institutions, where the compensation of an
19 employee is based upon an annual salary, a teaching or
20 professional year may be substituted for a calendar year in
21 determining the pay schedule.
