SYNOPSIS AS INTRODUCED:
 
70 ILCS 2605/5.15 new

    Amends the Metropolitan Water Reclamation District Act. Requires the Metropolitan Water Reclamation District to pay an impact fee of $203,442.14 to the county treasurer of Fulton County for the impact on that county of facilities located on real estate within that county that is owned and operated by the District. Requires the county treasurer to redistribute the impact fee to each taxing district in which that real property is located in the same proportion as the tax rate for each taxing district for taxable year 2003 bears to the total tax rate of all such taxing districts for taxable year 2003 under the Property Tax Code. Requires the District to pay the impact fee within 60 days after the effective date. Effective immediately.

1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Metropolitan Water Reclamation District Act
5 is amended by adding Section 5.15 as follows:
 
6     (70 ILCS 2605/5.15 new)
7     Sec. 5.15. Impact fees; Fulton County. For several years,
8 the District has owned and conducted operations on real estate
9 in Fulton County that is outside the territory of the District
10 and outside of Cook County. For example, the District owns and
11 operates a sludge reclamation facility in Fulton County. The
12 District's ownership and operations have an impact on the
13 public infrastructure and governmental service requirements of
14 the county. Therefore, the District must pay a one-time impact
15 fee of $203,442.14 to the county treasurer of Fulton County.
16 The county treasurer shall redistribute the impact fee to each
17 taxing district in the county in which the District's real
18 property is located in the same proportion as the tax rate for
19 each such taxing district for taxable year 2003 bears to the
20 total tax rate of all such taxing districts for taxable year
21 2003 under the Property Tax Code. The impact fee must be paid
22 within 60 days after the effective date of this Section.

24     Section 99. Effective date. This Act takes effect upon
25 becoming law.
