SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-2-12 new

    Amends the Unified Code of Corrections. Requires the Department of Corrections to increase the number of full-time correctional officers at each adult correctional institution by 5%. Prohibits the Department from allowing the staff at an adult correctional institution to be more than 5% below the required level for more than 30 days. Directs the Department to reduce the inmate population at an institution if necessary to meet the required staffing level.

1     AN ACT concerning criminal law.
 
2     WHEREAS, It is the purpose of this Act to protect the State
3 correctional officers that so diligently serve the State of
4 Illinois; and
 
5     WHEREAS, The State recognizes that stress on the staff
6 increases as a result of double-celling in the State adult
7 prisons, that the composition of the general inmate population
8 grows more violent, and that the decrease in the
9 staff-to-inmate ratio means that less supervision is available
10 to control a more dangerous inmate population; and
 
11     WHEREAS, The State also recognizes the need to maintain
12 adequate security staff in the State's adult institutions,
13 which house over 44,000 inmates, 11,445 more than their design
14 capacity; and
 
15     WHEREAS, The State is very concerned with the reported
16 number of assaults on correctional staff during the 2005 fiscal
17 year; and
 
18     WHEREAS, It is in the State's best interest to be sure that
19 an adequate number of security staff will always be maintained;
20 therefore
 
21     Be it enacted by the People of the State of Illinois,
22 represented in the General Assembly:
 
23     Section 5. The Unified Code of Corrections is amended by
24 adding Section 3-2-12 as follows:
 
25     (730 ILCS 5/3-2-12 new)
26     Sec. 3-2-12. Number of guards at adult institutions.
27     (a) Beginning July 1, 2007, the Department shall increase
28 the number of full-time correctional officers at each adult

1 correctional institution by 5% of the full-time authorized
2 headcount as of June 30, 2007. The Department of Corrections
3 shall thereafter maintain this minimum level of full-time
4 correctional officers at each adult correctional institution.
5     (b) In no instance may the Department allow the staff at an
6 adult correctional institution to be more than 5% below the
7 required level for more than 30 days. The Department shall
8 reduce the inmate population at an adult correctional
9 institution if necessary to meet the required staffing level.
10     (c) The Department shall adopt rules for the implementation
11 of this Section.
