SYNOPSIS AS INTRODUCED:

225 ILCS 225/8b new

Amends the Private Sewage Disposal Licensing Act. Expressly prohibits the Department from imposing National Pollutant Discharge Elimination System (NPDES) permit program fees under the Act, by rule and without the approval of the General Assembly. Effective immediately.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Private Sewage Disposal Licensing Act is amended by adding Section 8b as follows:

(225 ILCS 225/8b new)

Sec. 8b. NPDES permit program fees prohibited. The Department is expressly prohibited from imposing National Pollutant Discharge Elimination System (NPDES) permit program fees under this Act, by rule. The imposition of NPDES permit program fees under this Act must be approved by the Illinois General Assembly.

Section 99. Effective date. This Act takes effect upon becoming law.
