SYNOPSIS AS INTRODUCED:
 
765 ILCS 745/25.5 new

    Amends the Mobile Home Landlord and Tenant Rights Act. Creates the office of Mobile Home Park Ombudsman, appointed by the Governor. Directs the Ombudsman to act as a liaison between the State and mobile home park owners and tenants and to receive and investigate complaints related to mobile home park owners. Authorizes the Ombudsman to refer possible violations of the Act to the Attorney General for enforcement.

1     AN ACT concerning civil law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mobile Home Landlord and Tenant Rights Act
5 is amended by adding Section 25.5 as follows:
 
6     (765 ILCS 745/25.5 new)
7     Sec. 25.5. Mobile home park ombudsman.
8     (a) There is created within State government the office of
9 Mobile Home Park Ombudsman, hereinafter referred to as the
10 Ombudsman. The Ombudsman shall be appointed by the Governor
11 with the advice and consent of the Senate, shall serve at the
12 pleasure of the Governor, and shall receive compensation as set
13 by the Compensation Review Board.
14     (b) The Ombudsman shall serve as a liaison between the
15 State and mobile home park owners and tenants and shall protect
16 the rights and interests of mobile home owners against the
17 illegal or unreasonable actions of mobile home park owners. The
18 Ombudsman shall receive and investigate complaints related to
19 mobile home park owners, including complaints of actions or
20 omissions affecting the rights of mobile home owners under this
21 Act affecting the privacy and living conditions of mobile home
22 owners. The Ombudsman may initiate investigations of allegedly
23 unreasonable mobile home park fee and rent increases and
24 actions by mobile home park owners that impede a mobile home
25 owner's ability to sell his or her mobile home to the purchaser
26 of his or her choice. Any annual compensation paid to the
27 Ombudsman shall be paid through the Department of Public Health
28 from monies received from Section 6 of the Mobile Home Park
29 Act.
30     (c) If the Ombudsman believes that a park owner has engaged
31 in a pattern and practice to violate any provision of this Act,
32 the Ombudsman shall refer the matter to the Attorney General
