Amends the Illinois Municipal Code. Provides that, if a municipality annexes
part or all
of the territory in which a township operates a sewerage system, the authority responsible for operating the sewerage system within the annexed territory shall assume the responsibility for that portion of the
sewerage system
within the annexed territory. Provides that beginning on the annexation date, user fees for the sewerage system shall be collected by the municipality. Effective immediately.

| AN ACT concerning municipalities.

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Illinois Municipal Code is amended by adding |
| 5 |
| Section 11-141-10.1 as
follows:
|

| (65 ILCS 5/11-141-10.1 new)

| Sec. 11-141-10.1. Annexation of territory including |
| 8 |
| township sewerage
system. |
| 9 |
| (a) If a
municipality
annexes part or all of the territory |
| 10 |
| in which a township operates a sewerage
system that includes a |
| 11 |
| sewage treatment plant or plants, and if the
corporate |
| 12 |
| authorities of the municipality do not operate a sewerage |
| 13 |
| system that includes a sewage treatment plant or plants, the |
| 14 |
| township shall be responsible for that
portion of the
sewerage |
| 15 |
| system within the annexed territory. Any user fees attributable |
| 16 |
| to the annexed territory shall remain with the township, |
| 17 |
| unless, by agreement, the township assigns those fees. |
| 18 |
| (b) If a municipality annexes part or all of the territory |
| 19 |
| in which a township operates a sewerage system that does not |
| 20 |
| include a sewage treatment plant or plants, the authority |
| 21 |
| responsible for operating the sewerage system within the |
| 22 |
| annexed territory shall assume responsibility for that portion |
| 23 |
| of the sewerage system within the annexed territory. Beginning |
| 24 |
| upon the date of annexation, any user fees attributable to the |
| 25 |
| maintenance and operation of the sewerage system shall be |
| 26 |
| collected by the corporate authorities of the municipality.

| 27 |
| Section 99. Effective date. This Act takes effect upon |
| 28 |
| becoming law. |
