SYNOPSIS AS INTRODUCED:

    Amends the Animal Control Act. Defines a "companion animal" as one commonly considered, or considered by its owner, to be a pet. Redefines a "dangerous dog" to include one that injures a companion animal, livestock, or equidae. Redefines a "vicious dog" to include one that, while off its owner's property, kills a companion animal, livestock, or equidae and one that attacks a person and causes physical (now, serious physical) injury. Requires that animal control facilities annually report to the Department of Agriculture information including, but not limited to the facility's number of animal euthanasias, intakes, and sterilization procedures. Requires the Department to compile the reports and submit its findings to the Governor and General Assembly. Requires the Department to adopt implementing rules. Effective immediately.

1     AN ACT concerning animals, which may be referred to as
2 Marty's Law.
 
3     Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
 
5     Section 5. The Animal Control Act is amended by changing
6 Sections 2.05a and 2.19b and by adding Sections 2.04b and 22.5
7 as follows:
 
8     (510 ILCS 5/2.04b new)
9     Sec. 2.04b. Companion animal. "Companion animal" means an
10 animal that is commonly considered to be, or that is considered
11 by the owner to be, a pet. "Companion animal" includes, but is
12 not limited to, canines, felines, and equines.
 
13     (510 ILCS 5/2.05a)
14     Sec. 2.05a. "Dangerous dog" means (i) any individual dog
15 anywhere other than upon the property of the owner or custodian
16 of the dog and unmuzzled, unleashed, or unattended by its owner
17 or custodian that behaves in a manner that a reasonable person
18 would believe poses a serious and unjustified imminent threat
19 of serious physical injury or death to a person or a companion
20 animal, or (ii) a dog that, without justification, bites a
21 person and does not cause serious physical injury, or (iii) a
22 dog that injures a companion animal, livestock, or equidae.

25     Sec. 2.19b. "Vicious dog" means (i) a dog that, without
26 justification, attacks a person and causes serious physical
27 injury or death, (ii) a dog that, while off its owner's
28 property, kills any companion animal, livestock, or equidae, or
29 (iii) any individual dog that has been found to be a "dangerous
30 dog" upon 3 separate occasions.

2     (510 ILCS 5/22.5 new)
3     Sec. 22.5. Reports of animal control facilities.
4     (a) Each animal control facility in the State shall
5 annually report to the Department information required by the
6 Department including, but not limited to, the following:
7         (1) The number of the facility's animal euthanasias
8     during the reporting period.
9         (2) The number of the facility's animal intakes during
10     the reporting period.
11         (3) The number of the facility's spaying or neutering
12     procedures during the reporting period.
13     (b) The Department shall annually compile its findings
14 under subsection (a) and report those findings to the Governor
15 and General Assembly.
16     (c) The Department shall adopt rules for the implementation
17 of this Section.
 
18     Section 99. Effective date. This Act takes effect upon
19 becoming law.
