    Amends the Regulatory Sunset Act. Changes the repeal date of the Environmental Health Practitioner Licensing Act from January 1, 2007 to January 1, 2017. Amends the Environmental Health Practitioner Licensing Act. Provides that an environmental health care practitioner in training licensee whose license was issued under the grandfather provision of the Act may have his or her license renewed, so long as the licensee continues to practice environmental health and does not allow the license to expire and exempts such licensee from certain licensure requirements. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Regulatory Sunset Act is amended by changing
5 Section 4.17 and by adding Section 4.27 as follows:
 
6     (5 ILCS 80/4.17)
7     Sec. 4.17. Acts repealed on January 1, 2007. The following
8 are repealed on January 1, 2007:
9         The Boiler and Pressure Vessel Repairer Regulation
10     Act.
11         The Structural Pest Control Act.
12         Articles II, III, IV, V, V 1/2, VI, VIIA, VIIB, VIIC,
13     XVII, XXXI, XXXI 1/4, and XXXI 3/4 of the Illinois
14     Insurance Code.
15         The Clinical Psychologist Licensing Act.
16         The Illinois Optometric Practice Act of 1987.
17         The Medical Practice Act of 1987.
18         The Environmental Health Practitioner Licensing Act.

21     Sec. 4.27. Act repealed on January 1, 2017. The following
22 Act is repealed on January 1, 2017:
23     The Environmental Health Practitioner Licensing Act.
 
24     Section 10. The Environmental Health Practitioner
25 Licensing Act is amended by changing Sections 21 and 22 as
26 follows:

29     Sec. 21. Grandfather provision.

1     A person who, on the effective date of this amendatory Act
2 of the 92nd General Assembly, was certified by his or her
3 employer as serving as a sanitarian or environmental health
4 practitioner in environmental health practice in this State may
5 be issued a license as an environmental health practitioner in
6 training upon filing an application by July 1, 2003 and paying
7 the required fees. An environmental health care practitioner in
8 training license issued under this Section may be renewed, so
9 long as the licensee continues to practice environmental health
10 and does not allow his or her license to expire.

14     Sec. 22. Environmental health practitioner in training.
15     (a) Any person who meets the educational qualifications
16 specified in Section 20, but does not meet the experience
17 requirement specified in that Section, may make application to
18 the Department on a form prescribed by the Department for
19 licensure as an environmental health practitioner in training.
20 The Department shall license that person as an environmental
21 health practitioner in training upon payment of the fee
22 required by this Act.
23     (b) An environmental health practitioner in training
24 licensed under this Section shall apply for licensure as an
25 environmental health practitioner within 3 years of his or her
26 licensure as an environmental health practitioner in training.
27 The license may be renewed or extended as defined by rule of
28 the Department. The Board may extend the licensure of any
29 environmental health practitioner in training who is licensed
30 under this Section and furnishes, in writing, sufficient cause
31 for not applying for examination as an environmental health
32 practitioner within the 3-year period.
33     (c) An environmental health practitioner licensed under
34 this Section in training may engage in the practice of
35 environmental health for a period not to exceed 6 years

1 provided that he or she is supervised by a licensed
2 professional engineer or a licensed environmental health
3 practitioner as prescribed in this Act.
4     (d) This Section does not apply to environmental health
5 practitioners in training licensed under Section 21 of this
6 Act.

8     Section 99. Effective date. This Act takes effect upon
9 becoming law.
