1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Professional Counselor and Clinical
5 Professional Counselor Licensing Act is amended by changing
6 Section 20 as follows:
 
7     (225 ILCS 107/20)
8     (Section scheduled to be repealed on January 1, 2013)
9     Sec. 20. Restrictions and limitations.
10     (a) No person shall, without a valid license as a
11 professional counselor issued by the Department: (i) in any
12 manner hold himself or herself out to the public as a
13 professional counselor under this Act; (ii) attach the title
14 "professional counselor" or "licensed professional counselor";
15 or (iii) offer to render or render to individuals,
16 corporations, or the public professional counseling services
17 if the words "professional counselor" or "licensed
18 professional counselor" are used to describe the person
19 offering to render or rendering them, or "professional
20 counseling" is used to describe the services rendered or
21 offered to be rendered.
22     (b) No person shall, without a valid license as a clinical
23 professional counselor issued by the Department: (i) in any
24 manner hold himself or herself out to the public as a clinical
25 professional counselor or licensed clinical professional
26 counselor under this Act; (ii) attach the title "clinical
27 professional counselor" or "licensed clinical professional
28 counselor"; or (iii) offer to render to individuals,
29 corporations, or the public clinical professional counseling
30 services.
31     (c) Licensed professional counselors may not engage in
32 independent private practice as defined in this Act without a

1 clinical professional counseling license. In an independent
2 private practice, a licensed professional counselor must
3 practice at all times under the order, control, and full
4 professional responsibility of a licensed clinical
5 professional counselor, a licensed clinical social worker, a
6 licensed clinical psychologist, or a psychiatrist, as defined
7 in Section 1-121 of the Mental Health and Developmental
8 Disabilities Code.
9     (d) No association or partnership shall practice clinical
10 professional counseling or professional counseling unless
11 every member, partner, and employee of the association or
12 partnership who practices professional counseling or clinical
13 professional counseling, or who renders professional
14 counseling or clinical professional counseling services, holds
15 a currently valid license issued under this Act. No license
16 shall be issued to a corporation, the stated purpose of which
17 includes or which practices or which holds itself out as
18 available to practice professional counseling or clinical
19 professional counseling unless it is organized under the
20 Professional Service Corporation Act.
21     (e) Nothing in this Act shall be construed as permitting
22 persons licensed as professional counselors or clinical
23 professional counselors to engage in any manner in the practice
24 of medicine in all its branches as defined by law in this
25 State.
26     (f) When, in the course of providing professional
27 counseling or clinical professional counseling services to any
28 person, a professional counselor or clinical professional
29 counselor licensed under this Act finds indication of a disease
30 or condition that in his or her professional judgment requires
31 professional service outside the scope of practice as defined
32 in this Act, he or she shall refer that person to a physician
33 licensed to practice medicine in all of its branches or another
34 appropriate health care practitioner.
