SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/29D-31 new

    Amends the Criminal Code of 1961. Creates the offense of mass transit terrorism. Provides that a person commits the offense when he or she knowingly carries any explosive materials into a mass transit facility. Provides that a violation is a Class X felony with a mandatory term of imprisonment of not less than 30 years and not more than 60 years. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 29D-31 as follows:
 
6     (720 ILCS 5/29D-31 new)
7     Sec. 29D-31. Mass transit terrorism.
8     (a) A person commits the offense of mass transit terrorism
9 when he or she knowingly carries any explosive materials into a
10 mass transit facility.
11     (b) Sentence. Mass transit terrorism is a Class X felony
12 for which the offender shall be sentenced to a term of
13 imprisonment of not less than 30 years and not more than 60
14 years.
15     (c) Definitions. In this Section:
16         "Explosive materials" means explosives, blasting
17     agents, and detonators.
18         "Explosive" means any chemical compound, mixture, or
19     device, the primary or common purpose of which is to
20     function by explosion and includes high or low explosives.
21         "Mass transit facility" means any public
22     transportation facility, whether buses, trolley-buses, or
23     railway systems, utilized by a substantial number of
24     persons for their daily transportation, and includes not
25     only the public transportation facility itself but
26     ancillary and supporting facilities such as motor vehicle
27     parking facilities.
 
28     Section 99. Effective date. This Act takes effect upon
29 becoming law.
