SYNOPSIS AS INTRODUCED:

215 ILCS 106/65 new
215 ILCS 170/70 new
305 ILCS 5/5-26 new

Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that on and after July 1, 2006, the Department of Healthcare and Family Services may not expand the Children's Health Insurance Program (KidCare and FamilyCare), the Covering ALL KIDS Health Insurance Program, or the medical assistance (Medicaid) program by any means, including, but not limited to, (i) applying for waivers of federal law and regulations to cover additional services or groups of persons, (ii) increasing income eligibility limits or otherwise expanding the number of persons covered under the programs, or (iii) increasing the number or types of services covered under the programs. Effective immediately.

AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Children's Health Insurance Program Act is amended by adding Section 65 as follows:

Sec. 65. No expansion of program. On and after July 1, 2006, the Department may not expand the Children's Health Insurance Program by any means, including, but not limited to, (i) applying for waivers of federal law and regulations to cover additional services or groups of persons, (ii) increasing income eligibility limits or otherwise expanding the number of persons covered under the program, or (iii) increasing the number or types of services covered under the program.

Section 10. The Covering ALL KIDS Health Insurance Act is amended by adding Section 70 as follows:

Sec. 70. No expansion of program. On and after July 1, 2006, the Department may not expand the Covering ALL KIDS Health Insurance Program by any means, including, but not limited to, (i) applying for waivers of federal law and regulations to cover additional services or groups of persons, (ii) increasing income eligibility limits or otherwise expanding the number of persons covered under the program, or (iii) increasing the number or types of services covered under the program.

Section 15. The Illinois Public Aid Code is amended by adding Section 5-26 as follows:

Sec. 5-26. No expansion of program. On and after July 1, 2006, the Department of Healthcare and Family Services may not expand the medical assistance program under this Article by any means, including, but not limited to, (i) applying for waivers of federal law and regulations to cover additional services or groups of persons, (ii) increasing income eligibility limits or otherwise expanding the number of persons covered under the program, or (iii) increasing the number or types of services covered under the program.

Section 99. Effective date. This Act takes effect upon becoming law.
