SYNOPSIS AS INTRODUCED:
 
70 ILCS 920/5.4 new

    Amends the Tuberculosis Sanitarium District Act. Dissolves the Suburban Cook County Tuberculosis Sanitarium District on the day 4 months after the effective date of this amendatory Act. Provides for the transfer of the assets and liabilities of the District to the Cook County Board and requires the Cook County Department of Public Health to assume all responsibility for tuberculosis care and treatment of the District. Provides that on the day 2 months after the effective date of this amendatory Act the District Board shall forward all transition plans to the Cook County Department of Public Health. Provides that, upon dissolution of the District, District employees becomes employees of Cook County. Authorizes the Cook County Board to transfer to the Cook County Forest Preserve District appropriate unimproved real estate transferred to the Board as a result of the dissolution. Provides that any land owned by the District at the time of its dissolution remains the subject of any leases and encumbrances that existed upon the dissolution of the District, and if the land is subject to a lease, the land may not be taken by any unit of government during the term of the lease. Upon the dissolution of the Suburban Cook County Tuberculosis Sanitarium District, abolishes any levy imposed by the dissolved District and provides that Cook County, as a home rule unit, may impose a levy for the purpose of the care and treatment of tuberculosis and emerging respiratory disease in Cook County. Provides that, in accordance with certain provisions of the State Revenue Sharing Act, the tax base of the dissolved Suburban Cook County Tuberculosis Sanitarium District shall be added to the tax base of Cook County. Makes other changes. Effective immediately.

1     AN ACT concerning special districts.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Tuberculosis Sanitarium District Act is
5 amended by adding Section 5.4 as follows:
 
6     (70 ILCS 920/5.4 new)
7     Sec. 5.4. Dissolution of Suburban Cook County Tuberculosis
8 Sanitarium District; disposition of land and real estate;
9 continuation of District levy.
10     (a) Notwithstanding any provision of law to the contrary,
11 the Suburban Cook County Tuberculosis Sanitarium District is
12 dissolved by operation of law on the day 4 months after the
13 effective date of this amendatory Act of the 94th General
14 Assembly.
15     (b) On or before the day 2 months after the effective date
16 of this amendatory Act of the 94th General Assembly, the Board
17 of Directors shall forward to the Cook County Department of
18 Public Health all transition plans relating to the
19 consolidation of all of the existing programs, personnel, and
20 infrastructure of the District into the Cook County Bureau of
21 Health Services to be administered by the Cook County
22 Department of Public Health. Beginning on the effective date of
23 this amendatory Act of the 94th General Assembly, the District
24 shall not make any enhancements to pensions.
25     (c) Upon dissolution of the District: (i) all assets and
26 liabilities of the Suburban Cook County Tuberculosis
27 Sanitarium District dissolved under this amendatory Act of the
28 94th General Assembly shall be transferred to the Cook County
29 Board and the monetary assets shall be deposited into a special
30 purpose fund for the care and treatment of tuberculosis in
31 suburban Cook County; (ii) the Cook County Department of Public
32 Health shall assume all responsibility for tuberculosis care

1 and treatment of the Suburban Cook County Tuberculosis
2 Sanitarium District dissolved under this amendatory Act of the
3 94th General Assembly, including the provision of tuberculosis
4 care and treatment for units of local government with
5 State-certified local public health departments; and (iii)
6 employees of the Suburban Cook County Tuberculosis Sanitarium
7 District become employees of Cook County.
8     (d) The Cook County Board may transfer to the Cook County
9 Forest Preserve District appropriate unimproved real estate
10 owned by the Suburban Cook County Tuberculosis Sanitarium
11 District at the time of its dissolution. After the dissolution
12 of the District, any land owned by the District at the time of
13 its dissolution remains subject to any leases and encumbrances
14 that existed upon the dissolution of the District and, if the
15 land is subject to a lease, the land may not be taken by any
16 unit of government during the term of the lease.
17     (e) Upon the dissolution of the Suburban Cook County
18 Tuberculosis Sanitarium District: (i) any levy imposed by the
19 dissolved District is abolished and (ii) Cook County, as a home
20 rule unit, may impose a levy for the purpose of the care and
21 treatment of tuberculosis and emerging respiratory diseases,
22 including, but not limited to, severe acute respiratory
23 syndrome and avian flu, in Cook County. In accordance with
24 subsection (b) of Section 12 of the State Revenue Sharing Act,
25 the tax base of the dissolved Suburban Cook County Tuberculosis
26 Sanitarium District shall be added to the tax base of Cook
27 County.
 
28     Section 99. Effective date. This Act takes effect upon
29 becoming law.
