1     AN ACT concerning education.
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4     Section 5. The School Code is amended by changing Section
5 27-23.7 as follows:
6     (105 ILCS 5/27-23.7)
7     Sec. 27-23.7. Bullying prevention education.
8     (a) The General Assembly finds that bullying has a negative
9 effect on the social environment of schools, creates a climate
10 of fear among students, inhibits their ability to learn, and
11 leads to other antisocial behavior. Bullying behavior has been
12 linked to other forms of antisocial behavior, such as
13 vandalism, shoplifting, skipping and dropping out of school,
14 fighting, using drugs and alcohol, sexual harassment, and
15 sexual violence.
16     (b) In this Section, "bullying prevention" means and
17 includes instruction in all of the following:
18         (1) Intimidation.
19         (2) Student victimization.
20         (3) Sexual harassment.
21         (4) Sexual violence.
22         (5) Strategies for student-centered problem solving
23     regarding bullying.

1     (c) Each school district may make suitable provisions for
2 instruction in bullying prevention in all grades and include
3 such instruction in the courses of study regularly taught
4 therein. A school board may collaborate with a community-based
5 agency providing specialized curricula in bullying prevention
6 whose ultimate outcome is to prevent sexual violence. The State
7 Board of Education may assist in the development of
8 instructional materials and teacher training in relation to
9 bullying prevention.
10     (d) Beginning 180 days after the effective date of this
11 amendatory Act of the 95th General Assembly, each school
12 district shall create and maintain a policy on bullying, which
13 policy must be filed with the State Board of Education. Each
14 school district must communicate its policy on bullying to its
15 students and their parent or guardian on an annual basis. The
16 policy must be updated every 2 years and filed with the State
17 Board of Education after being updated. The State Board of
18 Education shall monitor the implementation of policies created
19 under this subsection (d).

21     Section 90. The State Mandates Act is amended by adding
22 Section 8.31 as follows:

24     Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8

1 of this Act, no reimbursement by the State is required for the
2 implementation of any mandate created by this amendatory Act of
3 the 95th General Assembly.
4     Section 99. Effective date. This Act takes effect upon
5 becoming law.
