1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Critical Health Problems and Comprehensive
5 Health Education Act is amended by changing Section 3 as
6 follows:
 
7     (105 ILCS 110/3)  (from Ch. 122, par. 863)
8     Sec. 3. Comprehensive Health Education Program. The
9 program established under this Act shall include, but not be
10 limited to, the following major educational areas as a basis
11 for curricula in all elementary and secondary schools in this
12 State: human ecology and health, human growth and development,
13 the emotional, psychological, physiological, hygienic and
14 social responsibilities of family life, including sexual
15 abstinence until marriage, prevention and control of disease,
16 including instruction in grades 6 through 12 on the prevention,
17 transmission and spread of AIDS, public and environmental
18 health, consumer health, safety education and disaster
19 survival, mental health and illness, personal health habits,
20 alcohol, drug use, and abuse including the medical and legal
21 ramifications of alcohol, drug, and tobacco use, abuse during
22 pregnancy, sexual abstinence until marriage, tobacco,
23 nutrition, and dental health. The program shall also provide

1 course material and instruction to advise pupils of the
2 Abandoned Newborn Infant Protection Act. Notwithstanding the
3 above educational areas, the following areas may also be
4 included as a basis for curricula in all elementary and
5 secondary schools in this State: basic first aid (including,
6 but not limited to, cardiopulmonary resuscitation and the
7 Heimlich maneuver), early prevention and detection of cancer,
8 heart disease, diabetes, stroke, and the prevention of child
9 abuse, neglect, and suicide.
10     The school board of each public elementary and secondary
11 school in the State shall encourage all teachers and other
12 school personnel to acquire, develop, and maintain the
13 knowledge and skills necessary to properly administer
14 life-saving techniques, including without limitation the
15 Heimlich maneuver and rescue breathing. The training shall be
16 in accordance with standards of the American Red Cross, the
17 American Heart Association, or another nationally recognized
18 certifying organization. A school board may use the services of
19 non-governmental entities whose personnel have expertise in
20 life-saving techniques to instruct teachers and other school
21 personnel in these techniques. Each school board is encouraged
22 to have in its employ, or on its volunteer staff, at least one
23 person who is certified, by the American Red Cross or by
24 another qualified certifying agency, as qualified to
25 administer first aid and cardiopulmonary resuscitation. In
26 addition, each school board is authorized to allocate

1 appropriate portions of its institute or inservice days to
2 conduct training programs for teachers and other school
3 personnel who have expressed an interest in becoming qualified
4 to administer emergency first aid or cardiopulmonary
5 resuscitation. School boards are urged to encourage their
6 teachers and other school personnel who coach school athletic
7 programs and other extracurricular school activities to
8 acquire, develop, and maintain the knowledge and skills
9 necessary to properly administer first aid and cardiopulmonary
10 resuscitation in accordance with standards and requirements
11 established by the American Red Cross or another qualified
12 certifying agency. Subject to appropriation, the State Board of
13 Education shall establish and administer a matching grant
14 program to pay for half of the cost that a school district
15 incurs in training those teachers and other school personnel
16 who express an interest in becoming qualified to administer
17 cardiopulmonary resuscitation (which training must be in
18 accordance with standards of the American Red Cross, the
19 American Heart Association, or another nationally recognized
20 certifying organization) or in learning how to use an automated
21 external defibrillator. A school district that applies for a
22 grant must demonstrate that it has funds to pay half of the
23 cost of the training for which matching grant money is sought.
24 The State Board of Education shall award the grants on a
25 first-come, first-serve basis.
26     No pupil shall be required to take or participate in any

1 class or course on AIDS or family life instruction if his
2 parent or guardian submits written objection thereto, and
3 refusal to take or participate in the course or program shall
4 not be reason for suspension or expulsion of the pupil.
5     Curricula developed under programs established in
6 accordance with this Act in the major educational area of
7 alcohol and drug use and abuse shall include classroom
8 instruction in grades 5 through 12. The instruction, which
9 shall include matters relating to both the physical and legal
10 effects and ramifications of drug and substance abuse, shall be
11 integrated into existing curricula; and the State Board of
12 Education shall develop and make available to all elementary
13 and secondary schools in this State instructional materials and
14 guidelines which will assist the schools in incorporating the
15 instruction into their existing curricula. In addition, school
16 districts may offer, as part of existing curricula during the
17 school day or as part of an after school program, support
18 services and instruction for pupils or pupils whose parent,
19 parents, or guardians are chemically dependent.
