    Amends the Illinois Public Aid Code. Makes technical changes in a Section concerning case management services.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 5-16.1 as follows:
 
6     (305 ILCS 5/5-16.1)  (from Ch. 23, par. 5-16.1)
7     Sec. 5-16.1. Case Management Services. The Illinois
8 Department may develop, implement and evaluate a Case
9 Management Services Program which provides services consistent
10 with the provisions of this Section, and the Inter-Agency
11 Agreement between the Department of Healthcare and Family
12 Services (formerly Department of Public Aid) and the Department
13 of Public Health, for a targeted population on a less than
14 Statewide basis in the State of Illinois. The purpose of this
15 Case Management Services Program shall be to assist eligible
16 participants in gaining access to needed medical, social,
17 educational and other services thereby reducing the likelihood
18 of long-term welfare dependency. The Case Management Services
19 Program shall have the following characteristics:
20         (a) It shall be conducted for a period of no less than
21     5 consecutive fiscal years in one urban area containing a
22     high proportion, as determined by Department of Healthcare
23     and Family Services Public Aid and Department of Public

1     Health records, of Medicaid eligible pregnant or parenting
2     girls under 17 years of age at the time of the initial
3     assessment and in one rural area containing a high
4     proportion, as determined by Department of Healthcare and
5     Family Services Public Aid and Department of Public Health
6     records, of Medicaid eligible pregnant or parenting girls
7     under 17 years of age at the time of the initial
8     assessment.
9         (b) Providers participating in the program shall be
10     paid an amount per patient per month, to be set by the
11     Illinois Department, for the case management services
12     provided.
13         (c) Providers eligible to participate in the program
14     shall be nurses or social workers, licensed to practice in
15     Illinois, who comply with the rules and regulations
16     established by the Illinois Department and the
17     Inter-Agency Agreement between the Department of
18     Healthcare and Family Services (formerly Department of
19     Public Aid) and the Department of Public Health. The
20     Illinois Department may terminate a provider's
21     participation in the program if the provider is determined
22     to have failed to comply with any applicable program
23     standard or procedure established by the Illinois
24     Department.
25         (d) Each eligible participant in an area where the Case
26     Management Services Program is being conducted may

1     voluntarily designate a case manager, of her own choosing
2     to assume responsibility for her care.
3         (e) A participant may change her designated case
4     manager provided that she informs the Illinois Department
5     by the 20th day of the month in order for the change to be
6     effective in the following month.
7         (f) The Illinois Department shall, by rule, establish
8     procedures for providing case management services when the
9     designated source becomes unavailable or wishes to
10     withdraw from any obligation as case management services
11     provider.
12         (g) In accordance with rules adopted by the Illinois
13     Department, a participant may discontinue participation in
14     the program upon timely notice to the Illinois Department,
15     in which case the participant shall remain eligible for
16     assistance under all applicable provisions of Article V of
17     this Code.
18     The Illinois Department shall take any necessary steps to
19 obtain authorization or waiver under federal law to implement a
20 Case Management Services Program. Participation shall be
21 voluntary for the provider and the recipient.
