    Amends the Public Utilities Act. Makes a technical change in a Section concerning fire protection charges imposed by water utilities.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by changing
5 Section 9-223 as follows:
 
6     (220 ILCS 5/9-223)  (from Ch. 111 2/3, par. 9-223)
7     Sec. 9-223. Fire protection charge.
8     (a) The The Commission may authorize any public utility
9 engaged in the production, storage, transmission, sale,
10 delivery or furnishing of water to impose a fire protection
11 charge, in addition to any rate authorized by this Act,
12 sufficient to cover a reasonable portion of the cost of
13 providing the capacity, facilities and the water necessary to
14 meet the fire protection needs of any municipality or public
15 fire protection district. Such fire protection charge shall be
16 in the form of a fixed amount per bill and shall be shown
17 separately on the utility bill of each customer of the
18 municipality or fire protection district. Any filing by a
19 public utility to impose such a fire protection charge or to
20 modify a charge shall be made pursuant to Section 9-201 of this
21 Act. Any fire protection charge imposed shall reflect the costs
22 associated with providing fire protection service for each
23 municipality or fire protection district. No such charge shall

1 be imposed directly on any municipality or fire protection
2 district for a reasonable level of fire protection services
3 unless provided for in a separate agreement between the
4 municipality or the fire protection district and the utility.
5     (b) By December 31, 2007, the Commission shall conduct at
6 least 3 public forums to evaluate the purpose and use of each
7 fire protection charge imposed under this Section. At least one
8 forum must be held in northern Illinois, at least one forum
9 must be held in central Illinois, and at least one forum must
10 be held in southern Illinois. The Commission must invite a
11 representative from each municipality and fire protection
12 district affected by a fire protection charge under this
13 Section to attend a public forum. The Commission shall report
14 its findings concerning recommendations concerning the purpose
15 and use of each fire protection charge to the General Assembly
16 no later than the last day of the veto session in 2008.
