Amends the Mental Health and Developmental Disabilities Code. Makes a technical change in a Section concerning the definition of "care and custody".

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Mental Health and Developmental Disabilities Code is amended by changing Section 1-102 as follows:

(405 ILCS 5/1-102) (from Ch. 91 1/2, par. 1-102)

Sec. 1-102. "Care and and custody" means authorization to an appropriate person, with his consent, to provide or arrange for proper and adequate treatment of another person who is subject to involuntary admission but does not include the authority to require hospitalization of the recipient unless such authority is expressly granted by court order pursuant to Article VII of Chapter III.
