Amends the School Code. Requires school districts to restrict access to vending machine products during times when school breakfasts and lunches are being served. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

A BILL FOR

AN ACT concerning schools.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Sections 10-20.40 and 34-18.34 as follows:

(105 ILCS 5/10-20.40 new)

Sec. 10-20.40. Vending machine access. Each school board shall restrict access to vending machine products during times when school breakfasts, if a school offers breakfast, and school lunches are being served.

Sec. 34-18.34. Vending machine access. The board shall restrict access to vending machine products during times when school breakfasts, if a school offers breakfast, and school lunches are being served.

Section 90. The State Mandates Act is amended by adding Section 8.31 as follows:

(30 ILCS 805/8.31 new)

Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8 of this Act, no reimbursement by the State is required for the implementation of any mandate created by this amendatory Act of the 95th General Assembly.

Section 99. Effective date. This Act takes effect upon becoming law.
