SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12-3.6 new

    Amends the Criminal Code of 1961. Creates the offense of domestic damage to property when a person knowingly or intentionally causes damage to a family or household member's personal property or commonly owned property while in the immediate presence of that family or household member so as to deliberately and intentionally intimidate or threaten that family or household member. Requires a peace officer to arrest the offender upon the establishment of probable cause. Makes the offense a Class A misdemeanor.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 12-3.6 as follows:
 
6     (720 ILCS 5/12-3.6 new)
7     Sec. 12-3.6. Domestic damage to property.
8     (a) A person commits domestic damage to property when he or
9 she knowingly or intentionally causes damage to a family or
10 household member's personal property or commonly owned
11 property while in the immediate presence of that family or
12 household member, as defined in subsection (3) of Section
13 112A-3 of the Code of Criminal Procedure of 1963, so as to
14 deliberately and intentionally intimidate or threaten that
15 family or household member. A peace officer must arrest the
16 offender upon the establishment of probable cause.
17     (b) Sentence. Domestic damage to property is a Class A
18 misdemeanor.
