1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Critical Health Problems and Comprehensive
5 Health Education Act is amended by changing Section 3 as
6 follows:
 
7     (105 ILCS 110/3)  (from Ch. 122, par. 863)
8     Sec. 3. Comprehensive Health Education Program. The
9 program established under this Act shall include, but not be
10 limited to, the following major educational areas as a basis
11 for curricula in all elementary and secondary schools in this
12 State: human ecology and health, human growth and development,
13 the emotional, psychological, physiological, hygienic and
14 social responsibilities of family life, including sexual
15 abstinence until marriage, prevention and control of disease,
16 including instruction in grades 6 through 12 on the prevention,
17 transmission and spread of AIDS, sexual assault awareness in
18 secondary schools, public and environmental health, consumer
19 health, safety education and disaster survival, mental health
20 and illness, personal health habits, alcohol, drug use, and
21 abuse including the medical and legal ramifications of alcohol,
22 drug, and tobacco use, abuse during pregnancy, sexual
23 abstinence until marriage, tobacco, nutrition, and dental

1 health. The program shall also provide course material and
2 instruction to advise pupils of the Abandoned Newborn Infant
3 Protection Act. Notwithstanding the above educational areas,
4 the following areas may also be included as a basis for
5 curricula in all elementary and secondary schools in this
6 State: basic first aid (including, but not limited to,
7 cardiopulmonary resuscitation and the Heimlich maneuver),
8 early prevention and detection of cancer, heart disease,
9 diabetes, stroke, and the prevention of child abuse, neglect,
10 and suicide. The school board of each public elementary and
11 secondary school in the State shall encourage all teachers and
12 other school personnel to acquire, develop, and maintain the
13 knowledge and skills necessary to properly administer
14 life-saving techniques, including without limitation the
15 Heimlich maneuver and rescue breathing. The training shall be
16 in accordance with standards of the American Red Cross, the
17 American Heart Association, or another nationally recognized
18 certifying organization. A school board may use the services of
19 non-governmental entities whose personnel have expertise in
20 life-saving techniques to instruct teachers and other school
21 personnel in these techniques. Each school board is encouraged
22 to have in its employ, or on its volunteer staff, at least one
23 person who is certified, by the American Red Cross or by
24 another qualified certifying agency, as qualified to
25 administer first aid and cardiopulmonary resuscitation. In
26 addition, each school board is authorized to allocate

1 appropriate portions of its institute or inservice days to
2 conduct training programs for teachers and other school
3 personnel who have expressed an interest in becoming qualified
4 to administer emergency first aid or cardiopulmonary
5 resuscitation. School boards are urged to encourage their
6 teachers and other school personnel who coach school athletic
7 programs and other extracurricular school activities to
8 acquire, develop, and maintain the knowledge and skills
9 necessary to properly administer first aid and cardiopulmonary
10 resuscitation in accordance with standards and requirements
11 established by the American Red Cross or another qualified
12 certifying agency. No pupil shall be required to take or
13 participate in any class or course on AIDS or family life
14 instruction if his parent or guardian submits written objection
15 thereto, and refusal to take or participate in the course or
16 program shall not be reason for suspension or expulsion of the
17 pupil.
18     Curricula developed under programs established in
19 accordance with this Act in the major educational area of
20 alcohol and drug use and abuse shall include classroom
21 instruction in grades 5 through 12. The instruction, which
22 shall include matters relating to both the physical and legal
23 effects and ramifications of drug and substance abuse, shall be
24 integrated into existing curricula; and the State Board of
25 Education shall develop and make available to all elementary
26 and secondary schools in this State instructional materials and

1 guidelines which will assist the schools in incorporating the
2 instruction into their existing curricula. In addition, school
3 districts may offer, as part of existing curricula during the
4 school day or as part of an after school program, support
5 services and instruction for pupils or pupils whose parent,
6 parents, or guardians are chemically dependent.

8     Section 10. The University of Illinois Act is amended by
9 adding Section 40 as follows:
 
10     (110 ILCS 305/40 new)
11     Sec. 40. Sexual assault awareness education. The
12 University shall provide some form of sexual assault awareness
13 education to all incoming students, whether through a seminar,
14 online training, or some other way of informing students.
 
15     Section 15. The Southern Illinois University Management
16 Act is amended by adding Section 25 as follows:
 
17     (110 ILCS 520/25 new)
18     Sec. 25. Sexual assault awareness education. The
19 University shall provide some form of sexual assault awareness
20 education to all incoming students, whether through a seminar,
21 online training, or some other way of informing students.

1     Section 20. The Chicago State University Law is amended by
2 adding Section 5-135 as follows:
 
3     (110 ILCS 660/5-135 new)
4     Sec. 5-135. Sexual assault awareness education. The
5 University shall provide some form of sexual assault awareness
6 education to all incoming students, whether through a seminar,
7 online training, or some other way of informing students.
 
8     Section 25. The Eastern Illinois University Law is amended
9 by adding Section 10-135 as follows:
 
10     (110 ILCS 665/10-135 new)
11     Sec. 10-135. Sexual assault awareness education. The
12 University shall provide some form of sexual assault awareness
13 education to all incoming students, whether through a seminar,
14 online training, or some other way of informing students.
 
15     Section 30. The Governors State University Law is amended
16 by adding Section 15-135 as follows:

18     Sec. 15-135. Sexual assault awareness education. The
19 University shall provide some form of sexual assault awareness
20 education to all incoming students, whether through a seminar,

1     Section 35. The Illinois State University Law is amended by
2 adding Section 20-140 as follows:
 
3     (110 ILCS 675/20-140 new)
4     Sec. 20-140. Sexual assault awareness education. The
5 University shall provide some form of sexual assault awareness
6 education to all incoming students, whether through a seminar,
7 online training, or some other way of informing students.
 
8     Section 40. The Northeastern Illinois University Law is
9 amended by adding Section 25-135 as follows:
 
10     (110 ILCS 680/25-135 new)
11     Sec. 25-135. Sexual assault awareness education. The
12 University shall provide some form of sexual assault awareness
13 education to all incoming students, whether through a seminar,
14 online training, or some other way of informing students.
 
15     Section 45. The Northern Illinois University Law is amended
16 by adding Section 30-145 as follows:

18     Sec. 30-145. Sexual assault awareness education. The
19 University shall provide some form of sexual assault awareness

2     Section 50. The Western Illinois University Law is amended
3 by adding Section 35-140 as follows:
 
4     (110 ILCS 690/35-140 new)
5     Sec. 35-140. Sexual assault awareness education. The
6 University shall provide some form of sexual assault awareness
7 education to all incoming students, whether through a seminar,
8 online training, or some other way of informing students.
 
9     Section 55. The Public Community College Act is amended by
10 adding Section 3-29.3 as follows:
 
11     (110 ILCS 805/3-29.3 new)
12     Sec. 3-29.3. Sexual assault awareness education. A
13 community college shall provide some form of sexual assault
14 awareness education to all incoming students, whether through a
15 seminar, online training, or some other way of informing
16 students.
 
17     Section 90. The State Mandates Act is amended by adding
18 Section 8.31 as follows:
 
19     (30 ILCS 805/8.31 new)
20     Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8

1 of this Act, no reimbursement by the State is required for the
2 implementation of any mandate created by this amendatory Act of
3 the 95th General Assembly.
