1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Children and Family Services Act is amended
5 by adding Section 33 as follows:
 
6     (20 ILCS 505/33 new)
7     Sec. 33. Reporting; deaths.
8     (a) To report, subject to appropriation, the number of
9 children who died while in the custody of the Department by the
10 county where the death occurred and as categorized by:
11         (1) the cause of death; and
12         (2) the type of out-of-home placement at the time of
13     death.
14     (b) The number of children with an open or active child
15 protective services case who died due to abuse, categorized by
16 the person or persons who had care or custody of the child at
17 the time of the child's death as follows:
18         (1) biological parent or parents;
19         (2) other family member;
20         (3) adoptive parent or parents;
21         (4) foster care parent or parents; or
22         (5) other out-of-home care provider.
23     (c) The number of children with an open or active child

1 protective services case who died due to abuse allegedly caused
2 by an adult household member who is not listed under subsection
3 (b) of this Section.
4     (d) By January 1, 2008, and each January 1 thereafter the
5 report for the previous State fiscal year shall be submitted in
6 writing to the Governor, the President of the Senate, the
7 Minority Leader of the Senate, the Speaker of the House of
8 Representatives, the Minority Leader of the House of
9 Representatives, and the State Librarian.
10     Based on the data presented in each report, the Department
11 shall, in as brief a format as possible, describe 3 to 5 major
12 challenges the Department faces in achieving the goal of safe
13 and permanent homes for abused and neglected children.
 
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
