SYNOPSIS AS INTRODUCED:

225 ILCS 60/33.5 new
225 ILCS 120/56.5 new

Amends the Medical Practice Act and the Wholesale Drug Distribution Licensing Act. In any calendar year, prohibits a physician from intentionally soliciting or accepting from a manufacturer and a manufacturer from intentionally conferring upon a physician any gift having a cumulative total value of more than $50. Excludes drug product samples and educational materials from the ban.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Medical Practice Act of 1987 is amended by adding Section 33.5 as follows:

(225 ILCS 60/33.5 new)

Sec. 33.5. Gift ban.

(a) In this Section:

"Gift" means any gratuity, discount, entertainment, hospitality, loan, forbearance, or other tangible or intangible item having monetary value including, but not limited to, cash, food, and drink. "Gift" does not include drug product samples or educational materials.

"Manufacturer" has the meaning given to the term in the Wholesale Drug Distribution Licensing Act.

(b) During any calendar year, no physician licensed under this Act shall intentionally solicit or accept any gift or gifts from a drug manufacturer having a cumulative total value of more than $50.

Section 10. The Wholesale Drug Distribution Licensing Act is amended by adding Section 56.5 as follows:

(b) During any calendar year, no manufacturer licensed under this Act may intentionally confer upon any physician licensed under the Medical Practice Act of 1987 any gift or gifts having a cumulative total value of more than $50.
