1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 42000 as follows:
 
6     (55 ILCS 5/42000 new)
7     Sec. 42000. Wind farms. A county may own and operate a wind
8 generation turbine farm, either individually or jointly with
9 another unit of local government, school district, or community
10 college district that is authorized to own and operate a wind
11 generation turbine farm, that directly or indirectly reduces
12 the energy or other operating costs of the county. The county
13 may ask for the assistance of any State agency, including
14 without limitation the Department of Commerce and Economic
15 Opportunity, the Illinois Power Agency, or the Environmental
16 Protection Agency, in obtaining financing options for a wind
17 generation turbine farm.
 
18     Section 10. The Illinois Municipal Code is amended by
19 adding Section 11-15.3-1 as follows:
 
20     (65 ILCS 5/11-15.3-1 new)
21     Sec. 11-15.3-1. Wind farms. A municipality may own and

1 operate a wind generation turbine farm, either individually or
2 jointly with another unit of local government, school district,
3 or community college district that is authorized to own and
4 operate a wind generation turbine farm, that directly or
5 indirectly reduces the energy or other operating costs of the
6 municipality. The municipality may ask for the assistance of
7 any State agency, including without limitation the Department
8 of Commerce and Economic Opportunity, the Illinois Power
9 Agency, or the Environmental Protection Agency, in obtaining
10 financing options for a wind generation turbine farm.
 
11     Section 15. The School Code is amended by changing and
12 renumbering Sections 10-20.40 and 34-18.34 as follows:
 
13     (105 ILCS 5/10-20.42)
14     Sec. 10-20.42 10-20.40. Wind farm. A school district may
15 own and operate a wind generation turbine farm, either
16 individually or jointly with a unit of local government, school
17 district, or community college district that is authorized to
18 own and operate a wind generation turbine farm, that directly
19 or indirectly reduces the energy or other operating costs of
20 the school district. The school district may ask for the
21 assistance of any State agency, including without limitation
22 the State Board of Education, the Illinois Power Agency, or the
23 Environmental Protection Agency, in obtaining financing
24 options for a wind generation turbine farm.

8 or indirectly reduces the energy or other operating costs of
9 the school district. The school district may ask for the
10 assistance of any State agency, including without limitation
11 the State Board of Education, the Illinois Power Agency, or the
12 Environmental Protection Agency, in obtaining financing
13 options for a wind generation turbine farm.

15     Section 20. The Public Community College Act is amended by
16 changing Section 3-42.3 as follows:
 
17     (110 ILCS 805/3-42.3)
18     Sec. 3-42.3. Wind farm. To own and operate a wind
19 generation turbine farm, either individually or jointly with a
20 unit of local government, school district, or community college
21 district that is authorized to own and operate a wind
22 generation turbine farm, that directly or indirectly reduces
23 the energy or other operating costs of the community college

7     Section 99. Effective date. This Act takes effect upon
8 becoming law.
