1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Central Management Services
5 Law of the Civil Administrative Code of Illinois is amended by
6 changing Section 405-315 as follows:
 
7     (20 ILCS 405/405-315)  (was 20 ILCS 405/67.24)
8     Sec. 405-315. Management of State buildings; security
9 force; fees.
10     (a) To manage, operate, maintain, and preserve from waste
11 the State buildings, facilities, structures, grounds, or other
12 real property transferred to the Department under Section
13 405-415, including, without limitation, the State buildings
14 listed below. The Department may rent portions of these and
15 other State buildings when in the judgment of the Director
16 those leases or subleases will be in the best interests of the
17 State. The leases or subleases shall not exceed 5 years unless
18 a greater term is specifically authorized.

1 when in the judgment of the Director those leases or subleases
2 will be in the best interests of the State.
3     Portions or all of the commercial space, which includes the
4 sub-basement, storage mezzanine, concourse, and ground and
5 second floors of the
6         James R. Thompson Center
7         Bounded by Lake, Clark, Randolph and LaSalle Streets
8         Chicago, Illinois
9 may be leased or subleased to persons, firms, partnerships,
10 associations, or individuals for terms not to exceed 15 years
11 subject to renewals when in the judgment of the Director those
12 leases or subleases will be in the best interests of the State.
13     The Director is authorized to rent portions of the above
14 described facilities to persons, firms, partnerships,
15 associations, or individuals for terms not to exceed 30 days
16 when those leases or subleases will not interfere with State
17 usage of the facility. This authority is meant to supplement
18 and shall not in any way be interpreted to restrict the
19 Director's ability to make portions of the State of Illinois
20 Building and the James R. Thompson Center available for
21 long-term commercial leases or subleases.
22     Notwithstanding the provisions above, the Department of
23 Children and Family Services and the Department of Human
24 Services (as successor to the Department of Rehabilitation
25 Services and the Department of Mental Health and Developmental
26 Disabilities) shall determine the allocation of space for

1 direct recipient care in their respective facilities. The
2 Department of Central Management Services shall consult with
3 the affected agency in the allocation and lease of surplus
4 space in these facilities. Potential lease arrangements shall
5 not endanger the direct recipient care responsibilities in
6 these facilities.
7     (b) (Blank). To appoint, subject to the Personnel Code,
8 persons to be members of a police and security force. Members
9 of the security force shall be peace officers when performing
10 duties pursuant to this Section and as such shall have all of
11 the powers possessed by policemen in cities and sheriffs,
12 including the power to make arrests on view or issue citations
13 for violations of State statutes or city or county ordinances,
14 except that in counties of more than 1,000,000 population, any
15 powers created by this subsection shall be exercised only (i)
16 when necessary to protect the property, personnel, or interests
17 of the Department or any State agency for whom the Department
18 manages, operates, or maintains property or (ii) when
19 specifically requested by appropriate State or local law
20 enforcement officials, and except that within counties of
21 1,000,000 or less population, these powers shall be exercised
22 only when necessary to protect the property, personnel, or
23 interests of the State of Illinois and only while on property
24 managed, operated, or maintained by the Department.
25     Nothing in this subsection shall be construed so as to make
26 it conflict with any provisions of, or rules promulgated under,

1 the Personnel Code.
2     (c) To charge reasonable fees for the lease, rental, use,
3 or occupancy of State facilities managed, operated, or
4 maintained by the Department. All moneys collected under this
5 Section shall be deposited in a revolving fund in the State
6 treasury known as the Facilities Management Revolving Fund.
7     (d) Provisions of this Section relating to the James R.
8 Thompson Center are subject to the provisions of Section 7.4 of
9 the State Property Control Act.

12     Section 10. The State Police Act is amended by adding
13 Section 24 as follows:
 
14     (20 ILCS 2610/24 new)
15     Sec. 24. Police and security force. The Director may
16 appoint, subject to the Personnel Code, persons to be members
17 of a police and security force. Members of the security force
18 shall be peace officers when performing duties pursuant to this
19 Section and as such shall have all of the powers possessed by
20 policemen in cities and sheriffs, including the power to make
21 arrests on view or issue citations for violations of State
22 statutes or city or county ordinances. Nothing in this Section
23 shall be construed so as to make it conflict with any
24 provisions of, or rules promulgated under, the Personnel Code.

1     Notwithstanding any other rulemaking authority that may
2 exist, neither the Governor nor any agency or agency head under
3 the jurisdiction of the Governor has any authority to make or
4 promulgate rules to implement or enforce the provisions of this
5 amendatory Act of the 95th General Assembly. If, however, the
6 Governor believes that rules are necessary to implement or
7 enforce the provisions of this amendatory Act of the 95th
8 General Assembly, the Governor may suggest rules to the General
9 Assembly by filing them with the Clerk of the House and
10 Secretary of the Senate and by requesting that the General
11 Assembly authorize such rulemaking by law, enact those
12 suggested rules into law, or take any other appropriate action
13 in the General Assembly's discretion. Nothing contained in this
14 amendatory Act of the 95th General Assembly shall be
15 interpreted to grant rulemaking authority under any other
16 Illinois statute where such authority is not otherwise
17 explicitly given. For the purposes of this amendatory Act of
18 the 95th General Assembly, "rules" is given the meaning
19 contained in Section 1-70 of the Illinois Administrative
20 Procedure Act, and "agency" and "agency head" are given the
21 meanings contained in Sections 1-20 and 1-25 of the Illinois
22 Administrative Procedure Act to the extent that such
23 definitions apply to agencies or agency heads under the
24 jurisdiction of the Governor.
 
25     Section 99. Effective date. This Act takes effect upon
26 becoming law.
