SYNOPSIS AS INTRODUCED:
 
225 ILCS 37/16

    Amends the Environmental Health Practitioner Licensing Act. Makes a technical change in a Section concerning exemptions from the Act.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Environmental Health Practitioner Licensing
5 Act is amended by changing Section 16 as follows:
 
6     (225 ILCS 37/16)
7     (Section scheduled to be repealed on December 31, 2008)
8     Sec. 16. Exemptions. This Act does not prohibit or restrict
9 any of the the following:
10     (1) A person performing the functions and duties of an
11 environmental health practitioner under the general
12 supervision of a licensed environmental health practitioner or
13 licensed professional engineer if that person (i) is not
14 responsible for the administration or supervision of one or
15 more employees engaged in an environmental health program, (ii)
16 establishes a method of verbal communication with the licensed
17 environmental health practitioner or licensed professional
18 engineer to whom they can refer and report questions, problems,
19 and emergency situations encountered in environmental health
20 practice, and (iii) has his or her written reports reviewed
21 monthly by a licensed environmental health practitioner or
22 licensed professional engineer.
23     (2) A person licensed in this State under any other Act

1 from engaging in the practice for which he or she is licensed.
2     (3) A person working in laboratories licensed by,
3 registered with, or operated by the State of Illinois.
4     (4) A person employed by a State-licensed health care
5 facility who engages in the practice of environmental health or
6 whose job responsibilities include ensuring that the
7 environment in the health care facility is healthy and safe for
8 employees, patients, and visitors.
9     (5) A person employed with the Illinois Department of
10 Agriculture who engages in meat and poultry inspections or
11 environmental inspections under the authority of the
12 Department of Agriculture.
13     (6) A person holding a degree of Doctor of Veterinary
14 Medicine and Surgery and licensed under the Veterinary Medicine
15 and Surgery Practice Act of 2004.
