SYNOPSIS AS INTRODUCED:

30 ILCS 105/8o new

Amends the State Finance Act. Requires that, within 30 days after the date that the first claim is made after the effective date of this amendatory Act for response action costs under the Illinois Pesticide Act, the State Treasurer must transfer from the General Revenue Fund to the Agrichemical Incident Response Trust Fund an amount equal to the aggregate amount of all transfers made since State Fiscal Year 2004 from the Agrichemical Incident Response Trust Fund under certain Sections of the State Finance Act. Provides that, if any amount is transferred out of the Agrichemical Incident Response Trust Fund into any other fund in the State treasury, then, within 60 days after that transfer, the State Treasurer shall transfer that same amount from the General Revenue Fund to the Agrichemical Incident Response Trust Fund. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Section 8o as follows:

Sec. 8o. Transfers to the Agrichemical Incident Response Trust Fund.

(a) Within 30 days after the date that the first claim is made after the effective date of this amendatory Act of the 95th General Assembly for response action costs under Section 22.3 of the Illinois Pesticide Act, the State Treasurer shall transfer from the General Revenue Fund to the Agrichemical Incident Response Trust Fund an amount equal to the aggregate amount of all transfers from the Agrichemical Incident Response Trust Fund under Sections 8.44 and 8.55 since State Fiscal Year 2004.

(b) If any amount is transferred out of the Agrichemical Incident Response Trust Fund into any other fund in the State treasury, then, within 60 days after that transfer, the State Treasurer shall transfer that same amount from the General Revenue Fund to the Agrichemical Incident Response Trust Fund.

Section 99. Effective date. This Act takes effect upon becoming law.
