1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Chicago Park District Act is amended by
5 changing Section 15 as follows:
 
6     (70 ILCS 1505/15)  (from Ch. 105, par. 333.15)
7     Sec. 15. Acquisition of real estate.
8     (a) The Chicago Park District may acquire by gift, grant,
9 purchase, or condemnation (and may incur indebtedness for the
10 purchase of) any real estate lands, riparian estates or rights,
11 and other property (including abandoned railroad
12 rights-of-way) required or needed for any park, for parkways,
13 driveways, or boulevards, or for extending, adorning, or
14 maintaining the same for the purpose of establishing,
15 acquiring, completing, enlarging, ornamenting, building,
16 rebuilding, and improving public parks, boulevards, bridges,
17 subways, viaducts, and approaches thereto, wharfs, piers,
18 jetties, air landing fields and basins, shore protection works,
19 pleasure grounds and ways, walks, pathways, driveways,
20 roadways, highways, and all public works, grounds, or
21 improvements under the control of and within the jurisdiction
22 of the park commissioners, including (i) filling in submerged
23 land for park purposes, (ii) constructing all buildings, field

1 houses, stadiums, shelters, conservatories, museums, service
2 shops, power plants, structures, playground devices, and
3 boulevard and building lighting systems, and (iii) building all
4 other types of permanent improvement and construction
5 necessary to render the property under the control of the park
6 commissioners usable for the enjoyment of that property as
7 public parks, parkways, boulevards, and pleasureways, whether
8 the land is located within or without the district, if the land
9 is deemed necessary for park purposes or for parkways,
10 driveways, or boulevards. The Chicago Park District shall have
11 no power of condemnation, however, as to real estate lands,
12 riparian rights or estates, or other property located outside
13 the district, but shall only have power to acquire that
14 property by gift, grant, or purchase.
15     (b) After December 31, 1958, the powers granted in this
16 Section are subject to and limited by the Chicago Park and City
17 Exchange of Functions Act. As provided in that Act and in
18 Section 7 of this Act, the Chicago Park District may not after
19 that date acquire, extend, and maintain boulevards, driveways,
20 roadways, and highways used as thoroughfares for vehicular
21 traffic into or within parks, or any bridges, subways,
22 viaducts, and approaches thereto.
23     (c) The Chicago Park District may acquire by lease or
24 permit the right to occupy and use real estate lands and
25 riparian estates for park and parkway purposes and may improve,
26 maintain, and equip the lands and estates when authorized by

1 the Commissioners.
2     (c-5) The Chicago Park District may sell, lease, or
3 otherwise convey all or any portion of District-owned property
4 that is used solely and exclusively as office or administrative
5 space.
6     (d) The power of condemnation conferred by this Act shall
7 be exercised in the manner provided for the exercise of the
8 right of eminent domain under the Eminent Domain Act.
