    Amends the Election Code. Modifies the statement of candidacy requirements to include an email address for the candidate. Provides that an election authority may not reject a statement of candidacy, and a person may not file an objection to a candidate's statement of candidacy, for failure to include an email address or because of an error in the email address provided.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Sections 7-10, 8-8, and 10-5 and by adding Section 1-26 as
6follows:
 
7    (10 ILCS 5/1-26 new)
8    Sec. 1-26. Candidate email address. Notwithstanding any
9other provision of law, an election authority may not reject a
10statement of candidacy, and a person may not file an objection
11to a candidate's statement of candidacy, for failure to
12include an email address or because of an error in the email
13address provided.

15    Sec. 7-10. Form of petition for nomination. The name of no
16candidate for nomination, or State central committeeperson, or
17township committeeperson, or precinct committeeperson, or ward
18committeeperson or candidate for delegate or alternate
19delegate to national nominating conventions, shall be printed
20upon the primary ballot unless a petition for nomination has
21been filed in his behalf as provided in this Article in

6    Each sheet of the petition other than the statement of
7candidacy and candidate's statement shall be of uniform size
8and shall contain above the space for signatures an
9appropriate heading giving the information as to name of
10candidate or candidates, in whose behalf such petition is
11signed; the office, the political party represented and place
12of residence; and the heading of each sheet shall be the same.
13    Such petition shall be signed by qualified primary
14electors residing in the political division for which the
15nomination is sought in their own proper persons only and
16opposite the signature of each signer, his residence address
17shall be written or printed. The residence address required to
18be written or printed opposite each qualified primary
19elector's name shall include the street address or rural route
20number of the signer, as the case may be, as well as the
21signer's county, and city, village or town, and state.
22However, the county or city, village or town, and state of
23residence of the electors may be printed on the petition forms
24where all of the electors signing the petition reside in the
25same county or city, village or town, and state. Standard

1abbreviations may be used in writing the residence address,
2including street number, if any. At the bottom of each sheet of
3such petition shall be added a circulator statement signed by
4a person 18 years of age or older who is a citizen of the
5United States, stating the street address or rural route
6number, as the case may be, as well as the county, city,
7village or town, and state; and certifying that the signatures
8on that sheet of the petition were signed in his or her
9presence and certifying that the signatures are genuine; and
10either (1) indicating the dates on which that sheet was
11circulated, or (2) indicating the first and last dates on
12which the sheet was circulated, or (3) for elections where the
13petition circulation period is 90 days, certifying that none
14of the signatures on the sheet were signed more than 90 days
15preceding the last day for the filing of the petition, or (4)
16for the 2022 general primary election only, certify that the
17signatures on the sheet were signed during the period of
18January 13, 2022 through March 14, 2022 or certify that the
19signatures on the sheet were signed during the period of
20January 13, 2022 through the date on which this statement was
21sworn or affirmed to and certifying that to the best of his or
22her knowledge and belief the persons so signing were at the
23time of signing the petitions qualified voters of the
24political party for which a nomination is sought. Such
25statement shall be sworn to before some officer authorized to
26administer oaths in this State.

1    Except as otherwise provided in this Code, no petition
2sheet shall be circulated more than 90 days preceding the last
3day provided in Section 7-12 for the filing of such petition.
4    The person circulating the petition, or the candidate on
5whose behalf the petition is circulated, may strike any
6signature from the petition, provided that:
7        (1) the person striking the signature shall initial
8    the petition at the place where the signature is struck;
9    and
10        (2) the person striking the signature shall sign a
11    certification listing the page number and line number of
12    each signature struck from the petition. Such
13    certification shall be filed as a part of the petition.
14    Such sheets before being filed shall be neatly fastened
15together in book form, by placing the sheets in a pile and
16fastening them together at one edge in a secure and suitable
17manner, and the sheets shall then be numbered consecutively.
18The sheets shall not be fastened by pasting them together end
19to end, so as to form a continuous strip or roll. All petition
20sheets which are filed with the proper local election
21officials, election authorities or the State Board of
22Elections shall be the original sheets which have been signed
23by the voters and by the circulator thereof, and not
24photocopies or duplicates of such sheets. Each petition must
25include as a part thereof, a statement of candidacy for each of
26the candidates filing, or in whose behalf the petition is

1filed. This statement shall set out the address of such
2candidate, an email address for the candidate, the office for
3which he is a candidate, shall state that the candidate is a
4qualified primary voter of the party to which the petition
5relates and is qualified for the office specified (in the case
6of a candidate for State's Attorney it shall state that the
7candidate is at the time of filing such statement a licensed
8attorney-at-law of this State), shall state that he has filed
9(or will file before the close of the petition filing period) a
10statement of economic interests as required by the Illinois
11Governmental Ethics Act, shall request that the candidate's
12name be placed upon the official ballot, and shall be
13subscribed and sworn to by such candidate before some officer
14authorized to take acknowledgment of deeds in the State and
15shall be in substantially the following form:

1    The petitions, when filed, shall not be withdrawn or added
2to, and no signatures shall be revoked except by revocation
3filed in writing with the State Board of Elections, election
4authority or local election official with whom the petition is
5required to be filed, and before the filing of such petition.
6Whoever forges the name of a signer upon any petition required
7by this Article is deemed guilty of a forgery and on conviction
8thereof shall be punished accordingly.
9    A candidate for the offices listed in this Section must
10obtain the number of signatures specified in this Section on
11his or her petition for nomination.
12    (a) Statewide office or delegate to a national nominating
13convention. Except as otherwise provided in this Code, if a
14candidate seeks to run for statewide office or as a delegate or
15alternate delegate to a national nominating convention elected
16from the State at-large, then the candidate's petition for
17nomination must contain at least 5,000 but not more than
1810,000 signatures.
19    (b) Congressional office or congressional delegate to a
20national nominating convention. Except as otherwise provided
21in this Code, if a candidate seeks to run for United States
22Congress or as a congressional delegate or alternate
23congressional delegate to a national nominating convention
24elected from a congressional district, then the candidate's
25petition for nomination must contain at least the number of

1signatures equal to 0.5% of the qualified primary electors of
2his or her party in his or her congressional district. In the
3first primary election following a redistricting of
4congressional districts, a candidate's petition for nomination
5must contain at least 600 signatures of qualified primary
6electors of the candidate's political party in his or her
7congressional district.
8    (c) County office. Except as otherwise provided in this
9Code, if a candidate seeks to run for any countywide office,
10including, but not limited to, county board chairperson or
11county board member, elected on an at-large basis, in a county
12other than Cook County, then the candidate's petition for
13nomination must contain at least the number of signatures
14equal to 0.5% of the qualified electors of his or her party who
15cast votes at the last preceding general election in his or her
16county. If a candidate seeks to run for county board member
17elected from a county board district, then the candidate's
18petition for nomination must contain at least the number of
19signatures equal to 0.5% of the qualified primary electors of
20his or her party in the county board district. In the first
21primary election following a redistricting of county board
22districts or the initial establishment of county board
23districts, a candidate's petition for nomination must contain
24at least the number of signatures equal to 0.5% of the
25qualified electors of his or her party in the entire county who
26cast votes at the last preceding general election divided by

1the total number of county board districts comprising the
2county board; provided that in no event shall the number of
3signatures be less than 25.
4    (d) County office; Cook County only.
5        (1) If a candidate seeks to run for countywide office
6    in Cook County, then the candidate's petition for
7    nomination must contain at least the number of signatures
8    equal to 0.5% of the qualified electors of his or her party
9    who cast votes at the last preceding general election in
10    Cook County.
11        (2) If a candidate seeks to run for Cook County Board
12    Commissioner, then the candidate's petition for nomination
13    must contain at least the number of signatures equal to
14    0.5% of the qualified primary electors of his or her party
15    in his or her county board district. In the first primary
16    election following a redistricting of Cook County Board of
17    Commissioners districts, a candidate's petition for
18    nomination must contain at least the number of signatures
19    equal to 0.5% of the qualified electors of his or her party
20    in the entire county who cast votes at the last preceding
21    general election divided by the total number of county
22    board districts comprising the county board; provided that
23    in no event shall the number of signatures be less than 25.
24        (3) Except as otherwise provided in this Code, if a
25    candidate seeks to run for Cook County Board of Review
26    Commissioner, which is elected from a district pursuant to

1    subsection (c) of Section 5-5 of the Property Tax Code,
2    then the candidate's petition for nomination must contain
3    at least the number of signatures equal to 0.5% of the
4    total number of registered voters in his or her board of
5    review district in the last general election at which a
6    commissioner was regularly scheduled to be elected from
7    that board of review district. In no event shall the
8    number of signatures required be greater than the
9    requisite number for a candidate who seeks countywide
10    office in Cook County under subsection (d)(1) of this
11    Section. In the first primary election following a
12    redistricting of Cook County Board of Review districts, a
13    candidate's petition for nomination must contain at least
14    4,000 signatures or at least the number of signatures
15    required for a countywide candidate in Cook County,
16    whichever is less, of the qualified electors of his or her
17    party in the district.
18    (e) Municipal or township office. If a candidate seeks to
19run for municipal or township office, then the candidate's
20petition for nomination must contain at least the number of
21signatures equal to 0.5% of the qualified primary electors of
22his or her party in the municipality or township. If a
23candidate seeks to run for alderperson of a municipality, then
24the candidate's petition for nomination must contain at least
25the number of signatures equal to 0.5% of the qualified
26primary electors of his or her party of the ward. In the first

1primary election following redistricting of wards or trustee
2districts of a municipality or the initial establishment of
3wards or districts, a candidate's petition for nomination must
4contain the number of signatures equal to at least 0.5% of the
5total number of votes cast for the candidate of that political
6party who received the highest number of votes in the entire
7municipality at the last regular election at which an officer
8was regularly scheduled to be elected from the entire
9municipality, divided by the number of wards or districts. In
10no event shall the number of signatures be less than 25.
11    (f) State central committeeperson. If a candidate seeks to
12run for State central committeeperson, then the candidate's
13petition for nomination must contain at least 100 signatures
14of the primary electors of his or her party of his or her
15congressional district.
16    (g) Sanitary district trustee. Except as otherwise
17provided in this Code, if a candidate seeks to run for trustee
18of a sanitary district in which trustees are not elected from
19wards, then the candidate's petition for nomination must
20contain at least the number of signatures equal to 0.5% of the
21primary electors of his or her party from the sanitary
22district. If a candidate seeks to run for trustee of a sanitary
23district in which trustees are elected from wards, then the
24candidate's petition for nomination must contain at least the
25number of signatures equal to 0.5% of the primary electors of
26his or her party in the ward of that sanitary district. In the

1first primary election following redistricting of sanitary
2districts elected from wards, a candidate's petition for
3nomination must contain at least the signatures of 150
4qualified primary electors of his or her ward of that sanitary
5district.
6    (h) Judicial office. Except as otherwise provided in this
7Code, if a candidate seeks to run for judicial office in a
8district, then the candidate's petition for nomination must
9contain the number of signatures equal to 0.4% of the number of
10votes cast in that district for the candidate for his or her
11political party for the office of Governor at the last general
12election at which a Governor was elected, but in no event less
13than 500 signatures. If a candidate seeks to run for judicial
14office in a circuit or subcircuit, then the candidate's
15petition for nomination must contain the number of signatures
16equal to 0.25% of the number of votes cast for the judicial
17candidate of his or her political party who received the
18highest number of votes at the last general election at which a
19judicial officer from the same circuit or subcircuit was
20regularly scheduled to be elected, but in no event less than
211,000 signatures in circuits and subcircuits located in the
22First Judicial District or 500 signatures in every other
23Judicial District.
24    (i) Precinct, ward, and township committeeperson. Except
25as otherwise provided in this Code, if a candidate seeks to run
26for precinct committeeperson, then the candidate's petition

1for nomination must contain at least 10 signatures of the
2primary electors of his or her party for the precinct. If a
3candidate seeks to run for ward committeeperson, then the
4candidate's petition for nomination must contain no less than
5the number of signatures equal to 10% of the primary electors
6of his or her party of the ward, but no more than 16% of those
7same electors; provided that the maximum number of signatures
8may be 50 more than the minimum number, whichever is greater.
9If a candidate seeks to run for township committeeperson, then
10the candidate's petition for nomination must contain no less
11than the number of signatures equal to 5% of the primary
12electors of his or her party of the township, but no more than
138% of those same electors; provided that the maximum number of
14signatures may be 50 more than the minimum number, whichever
15is greater.
16    (j) State's attorney or regional superintendent of schools
17for multiple counties. If a candidate seeks to run for State's
18attorney or regional Superintendent of Schools who serves more
19than one county, then the candidate's petition for nomination
20must contain at least the number of signatures equal to 0.5% of
21the primary electors of his or her party in the territory
22comprising the counties.
23    (k) Any other office. If a candidate seeks any other
24office, then the candidate's petition for nomination must
25contain at least the number of signatures equal to 0.5% of the
26registered voters of the political subdivision, district, or

1division for which the nomination is made or 25 signatures,
2whichever is greater.
3    For purposes of this Section the number of primary
4electors shall be determined by taking the total vote cast, in
5the applicable district, for the candidate for that political
6party who received the highest number of votes, statewide, at
7the last general election in the State at which electors for
8President of the United States were elected. For political
9subdivisions, the number of primary electors shall be
10determined by taking the total vote cast for the candidate for
11that political party who received the highest number of votes
12in the political subdivision at the last regular election at
13which an officer was regularly scheduled to be elected from
14that subdivision. For wards or districts of political
15subdivisions, the number of primary electors shall be
16determined by taking the total vote cast for the candidate for
17that political party who received the highest number of votes
18in the ward or district at the last regular election at which
19an officer was regularly scheduled to be elected from that
20ward or district.
21    A "qualified primary elector" of a party may not sign
22petitions for or be a candidate in the primary of more than one
23party.
24    The changes made to this Section by Public Act 93-574 are
25declarative of existing law, except for item (3) of subsection
26(d).

1    Petitions of candidates for nomination for offices herein
2specified, to be filed with the same officer, may contain the
3names of 2 or more candidates of the same political party for
4the same or different offices. In the case of the offices of
5Governor and Lieutenant Governor, a joint petition including
6one candidate for each of those offices must be filed.

10    Sec. 8-8. Form of petition for nomination. The name of no
11candidate for nomination shall be printed upon the primary
12ballot unless a petition for nomination shall have been filed
13in his behalf as provided for in this Section. Each such
14petition shall include as a part thereof the oath required by
15Section 7-10.1 of this Code and a statement of candidacy by the
16candidate filing or in whose behalf the petition is filed.
17This statement shall set out the address of such candidate, an
18email address for the candidate, and the office for which he is
19a candidate; shall state that the candidate is a qualified
20primary voter of the party to which the petition relates, is
21qualified for the office specified, and has filed a statement
22of economic interests as required by the Illinois Governmental
23Ethics Act; shall request that the candidate's name be placed
24upon the official ballot; and shall be subscribed and sworn by
25such candidate before some officer authorized to take

22    The receipt issued by the Secretary of State indicating
23that the candidate has filed the statement of economic
24interests required by the Illinois Governmental Ethics Act
25must be filed with the petitions for nomination as provided in
26subsection (8) of Section 7-12 of this Code.

1    Except as otherwise provided in this Code, all petitions
2for nomination for the office of State Senator shall be signed
3by at least 1,000 but not more than 3,000 of the qualified
4primary electors of the candidate's party in his legislative
5district.
6    Except as otherwise provided in this Code, all petitions
7for nomination for the office of Representative in the General
8Assembly shall be signed by at least 500 but not more than
91,500 of the qualified primary electors of the candidate's
10party in his or her representative district.
11    Opposite the signature of each qualified primary elector
12who signs a petition for nomination for the office of State
13Representative or State Senator such elector's residence
14address shall be written or printed. The residence address
15required to be written or printed opposite each qualified
16primary elector's name shall include the street address or
17rural route number of the signer, as the case may be, as well
18as the signer's county and city, village, or town.
19    For the purposes of this Section, the number of primary
20electors shall be determined by taking the total vote cast, in
21the applicable district, for the candidate for such political
22party who received the highest number of votes, state-wide, at
23the last general election in the State at which electors for
24President of the United States were elected.
25    A "qualified primary elector" of a party may not sign
26petitions for or be a candidate in the primary of more than one

1party.
2    In the affidavit at the bottom of each sheet, the petition
3circulator, who shall be a person 18 years of age or older who
4is a citizen of the United States, shall state his or her
5street address or rural route number, as the case may be, as
6well as his or her county, city, village or town, and state;
7and shall certify that the signatures on that sheet of the
8petition were signed in his or her presence; and shall certify
9that the signatures are genuine; and shall certify that, to
10the best of his or her knowledge and belief, the persons so
11signing were at the time of signing the petition qualified
12primary voters for which the nomination is sought.
13    In the affidavit at the bottom of each petition sheet, the
14petition circulator shall (1) indicate the dates on which he
15or she circulated that sheet, or (2) indicate the first and
16last dates on which the sheet was circulated, or (3) for
17elections where the petition circulation period is 90 days,
18certify that none of the signatures on the sheet were signed
19more than 90 days preceding the last day for the filing of the
20petition, or (4) for the 2022 general primary election only,
21certify that the signatures on the sheet were signed during
22the period of January 13, 2022 through March 14, 2022 or
23certify that the signatures on the sheet were signed during
24the period of January 13, 2022 through the date on which this
25statement was sworn or affirmed to. No petition sheet shall be
26circulated more than 90 days preceding the last day provided

1in Section 8-9 for the filing of such petition.
2    All petition sheets which are filed with the State Board
3of Elections shall be the original sheets which have been

19    Sec. 10-5. All petitions for nomination shall, besides
20containing the names of candidates, specify as to each:
21    1. The office or offices to which such candidate or
22candidates shall be nominated.
23    2. The new political party, if any, represented, expressed
24in not more than 5 words. However, such party shall not bear
25the same name as, nor include the name of any established

1political party as defined in this Article. This prohibition
2does not preclude any established political party from making
3nominations in those cases in which it is authorized to do so.
4    3. The place of residence of any such candidate or
5candidates with the street and number thereof, if any. In the
6case of electors for President and Vice-President of the
7United States, the names of candidates for President and
8Vice-President may be added to the party name or appellation.
9    Such certificate of nomination or nomination papers in
10addition shall include as a part thereof, the oath required by
11Section 7-10.1 of this Act and must include a statement of
12candidacy for each of the candidates named therein, except
13candidates for electors for President and Vice-President of
14the United States. Each such statement shall set out the
15address of such candidate, an email address for the candidate,
16the office for which he is a candidate, shall state that the
17candidate is qualified for the office specified and has filed
18(or will file before the close of the petition filing period) a
19statement of economic interests as required by the Illinois
20Governmental Ethics Act, shall request that the candidate's
21name be placed upon the official ballot and shall be
22subscribed and sworn to by such candidate before some officer
23authorized to take acknowledgments of deeds in this State, and
24may be in substantially the following form:

19    In addition, a new political party petition shall have
20attached thereto a certificate stating the names and addresses
21of the party officers authorized to fill vacancies in
22nomination pursuant to Section 10-11.
23    Nomination papers filed under this Section are not valid
24if the candidate named therein fails to file a statement of
25economic interests as required by the Illinois Governmental
26Ethics Act in relation to his candidacy with the appropriate

1officer by the end of the period for the filing of nomination
2papers unless he has filed a statement of economic interests
3in relation to the same governmental unit with that officer
4during the same calendar year as the year in which such
5nomination papers were filed. If the nomination papers of any
6candidate and the statement of economic interest of that
7candidate are not required to be filed with the same officer,
8the candidate must file with the officer with whom the
9nomination papers are filed a receipt from the officer with
10whom the statement of economic interests is filed showing the
11date on which such statement was filed. Such receipt shall be
12so filed not later than the last day on which nomination papers
13may be filed.
