1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
524-14 as follows:
 
6    (105 ILCS 5/24-14)  (from Ch. 122, par. 24-14)
7    Sec. 24-14. Termination of contractual continued service
8by teacher. As used in this Section, "teaching assignment"
9means any full-time position that requires licensure under
10Article 21B of this Code.
11    A teacher, as defined in Section 24-11 of this Code, who
12has entered into contractual continued service may resign at
13any time by obtaining concurrence of the board or by serving at
14least 30 days' written notice upon the secretary of the board.
15During the school term, However, no teacher may resign during
16the school term, without the concurrence of the board, in
17order to accept another teaching assignment. Outside of a
18school term, a resignation submitted by any teacher after the
19completion of the school year must be submitted in writing to
20the secretary of the board a minimum of 30 calendar days prior
21to the first student attendance day of the following school
22year or else the teacher will be deemed to have resigned during
23the school term. Any teacher terminating said service not in

1accordance with this Section may be referred by the board to
2the State Superintendent of Education. A referral to the State
3Superintendent for an alleged violation of this Section must
4include (i) a dated copy of the teacher's resignation letter,
5(ii) a copy of the reporting district's current school year
6calendar, (iii) proof of employment for the school year at
7issue, (iv) documentation showing that the district's board
8did not accept the teacher's resignation, and (v) evidence
9that the teacher left the district in order to accept another
10teaching assignment. If the district intends to submit a
11referral to the State Superintendent, the district shall
12submit the referral to the State Superintendent within 10
13business days after the board denies acceptance of the
14resignation. The district shall notify the teacher that it
15submitted the referral to the State Superintendent within 5
16business days after submitting the referral to the State
17Superintendent. The State Superintendent or his or her
18designee shall convene an informal evidentiary hearing no
19later than 90 days after receipt of the required documentation
20from the school district as required in this Section of a
21resolution by the board. The teacher shall receive a written
22determination from the State Superintendent or his or her
23designee no later than 14 days after the hearing is completed.
24If the State Superintendent or his or her designee finds that
25the teacher resigned during the school term without the
26concurrence of the board to accept another teaching

1assignment, the State Superintendent must suspend the
2teacher's license for one calendar year. In lieu of a hearing
3and finding, the teacher may agree to a lesser licensure
4sanction at the discretion of the State Superintendent or his
5or her designee.

7    Section 99. Effective date. This Act takes effect upon
8becoming law.
