SYNOPSIS AS INTRODUCED:

    Amends the Election Code. Provides that the date of the general election on the first Tuesday after the first Monday of November in even years (rather than November 8, 2022) shall be a State holiday known as General Election Day and shall be observed throughout the State. Makes conforming changes. Amends the Illinois Procurement Code, School Code, and State Universities Civil Service Act making conforming changes. Effective immediately.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by adding Section
52A-1.1d as follows:
 
6    (10 ILCS 5/2A-1.1d new)
7    Sec. 2A-1.1d. General Election Day State holiday.
8Notwithstanding any other provision of State law to the
9contrary, the date of the general election on the first
10Tuesday after the first Monday of November in even years shall
11be a State holiday known as General Election Day and shall be
12observed throughout the State. General Election Day is a legal
13school holiday for purposes of the School Code and State
14Universities Civil Service Act. Any school closed for General
15Election Day shall be made available to an election authority
16as a polling place for General Election Day.
 
17    Section 10. The Illinois Procurement Code is amended by
18changing Section 15-45 as follows:

20    Sec. 15-45. Computation of days. The time within which any
21act provided in this Code is to be done shall be computed by

1excluding the first day and including the last, unless the
2last day is Saturday or Sunday or is a holiday, and then it
3shall also be excluded. If the day succeeding a Saturday,
4Sunday, or holiday is also a holiday, a Saturday, or a Sunday,
5then that succeeding day shall also be excluded. For the
6purposes of this Code, "holiday" means: New Year's Day; Dr.
7Martin Luther King, Jr.'s Birthday; Lincoln's Birthday;
8President's Day; Memorial Day; Juneteenth National Freedom
9Day; Independence Day; Labor Day; Columbus Day; General
10Election Day; Veterans' Day; Thanksgiving Day; Christmas Day;
11and any other day from time to time declared by the President
12of the United States or the Governor of Illinois to be a day
13during which the agencies of the State of Illinois that are
14ordinarily open to do business with the public shall be closed
15for business.
16    Notwithstanding any other provision of State law to the
17contrary, November 3, 2020 shall be a State holiday known as
182020 General Election Day and shall be observed throughout the
19State pursuant to this amendatory Act of the 101st General
20Assembly.

23    Section 15. The School Code is amended by changing Section
2424-2 as follows:

2    Sec. 24-2. Holidays.
3    (a) Teachers shall not be required to teach on Saturdays,
4nor, except as provided in subsection (b) of this Section,
5shall teachers or other school employees, other than
6noncertificated school employees whose presence is necessary
7because of an emergency or for the continued operation and
8maintenance of school facilities or property, be required to
9work on legal school holidays, which are January 1, New Year's
10Day; the third Monday in January, the Birthday of Dr. Martin
11Luther King, Jr.; February 12, the Birthday of President
12Abraham Lincoln; the first Monday in March (to be known as
13Casimir Pulaski's birthday); Good Friday; the day designated
14as Memorial Day by federal law; June 19, Juneteenth National
15Freedom Day; July 4, Independence Day; the first Monday in
16September, Labor Day; the second Monday in October, Columbus
17Day; the first Tuesday after the first Monday of November in
18even years, General Election Day; November 11, Veterans' Day;
19the Thursday in November commonly called Thanksgiving Day; and
20December 25, Christmas Day. School boards may grant special
21holidays whenever in their judgment such action is advisable.
22No deduction shall be made from the time or compensation of a
23school employee on account of any legal or special holiday.
24    (b) A school board or other entity eligible to apply for
25waivers and modifications under Section 2-3.25g of this Code
26is authorized to hold school or schedule teachers' institutes,

1parent-teacher conferences, or staff development on the third
2Monday in January (the Birthday of Dr. Martin Luther King,
3Jr.); February 12 (the Birthday of President Abraham Lincoln);
4the first Monday in March (known as Casimir Pulaski's
5birthday); the second Monday in October (Columbus Day); and
6November 11 (Veterans' Day), provided that:
7        (1) the person or persons honored by the holiday are
8    recognized through instructional activities conducted on
9    that day or, if the day is not used for student attendance,
10    on the first school day preceding or following that day;
11    and
12        (2) the entity that chooses to exercise this authority
13    first holds a public hearing about the proposal. The
14    entity shall provide notice preceding the public hearing
15    to both educators and parents. The notice shall set forth
16    the time, date, and place of the hearing, describe the
17    proposal, and indicate that the entity will take testimony
18    from educators and parents about the proposal.
19    (c) Commemorative holidays, which recognize specified
20patriotic, civic, cultural or historical persons, activities,
21or events, are regular school days. Commemorative holidays
22are: January 17 (the birthday of Muhammad Ali), January 28 (to
23be known as Christa McAuliffe Day and observed as a
24commemoration of space exploration), February 15 (the birthday
25of Susan B. Anthony), March 29 (Viet Nam War Veterans' Day),
26September 11 (September 11th Day of Remembrance), the school

1day immediately preceding Veterans' Day (Korean War Veterans'
2Day), October 1 (Recycling Day), October 7 (Iraq and
3Afghanistan Veterans Remembrance Day), December 7 (Pearl
4Harbor Veterans' Day), and any day so appointed by the
5President or Governor. School boards may establish
6commemorative holidays whenever in their judgment such action
7is advisable. School boards shall include instruction relative
8to commemorated persons, activities, or events on the
9commemorative holiday or at any other time during the school
10year and at any point in the curriculum when such instruction
11may be deemed appropriate. The State Board of Education shall
12prepare and make available to school boards instructional
13materials relative to commemorated persons, activities, or
14events which may be used by school boards in conjunction with
15any instruction provided pursuant to this paragraph.
16    (d) City of Chicago School District 299 shall observe
17March 4 of each year as a commemorative holiday. This holiday
18shall be known as Mayors' Day which shall be a day to
19commemorate and be reminded of the past Chief Executive
20Officers of the City of Chicago, and in particular the late
21Mayor Richard J. Daley and the late Mayor Harold Washington.
22If March 4 falls on a Saturday or Sunday, Mayors' Day shall be
23observed on the following Monday.
24    (e) Notwithstanding any other provision of State law to
25the contrary, November 3, 2020 shall be a State holiday known
26as 2020 General Election Day and shall be observed throughout

1the State pursuant to this amendatory Act of the 101st General
2Assembly. All government offices, with the exception of
3election authorities, shall be closed for General Election Day
4unless authorized to be used as a location for election day
5services or as a polling place.
6    Notwithstanding any other provision of State law to the
7contrary, November 8, 2022 shall be a State holiday known as
82022 General Election Day and shall be observed throughout the
9State under Public Act 102-15.

13    Section 20. The State Universities Civil Service Act is
14amended by changing Section 45a as follows:
 
15    (110 ILCS 70/45a)  (from Ch. 24 1/2, par. 38l.1)
16    Sec. 45a. Except as provided in the second sentence of
17this Section, all officers and employees subject to this Act,
18shall have the following days as holidays, for which they
19shall receive their usual compensation: New Year's Day,
20January 1, Memorial Day, as determined by the law of the State
21of Illinois, Juneteenth National Freedom Day, as determined by
22the law of the State of Illinois, Independence Day, July 4,
23Labor Day, the first Monday in September, General Election
24Day, the first Tuesday after the first Monday of November in

1even years, Thanksgiving Day, the fourth Thursday of November,
2Christmas Day, December 25, and five holidays to be designated
3by each college, university, or agency subject to this Act.
4Craft and trade employees subject to this Act shall be paid for
5all paid holidays included in their area agreement, and will
6be paid for all five holidays designated by their employer
7pursuant to this Section.
8    College, university, agency, and community college offices
9Notwithstanding any other provision of State law to the
10contrary, November 3, 2020 shall be a State holiday known as
112020 General Election Day and shall be observed throughout the
12State pursuant to this amendatory Act of the 101st General
13Assembly. All government offices, with the exception of
14election authorities, shall be closed on General Election Day
15unless authorized to be used as a location for election day
16services or as a polling place.
17    Notwithstanding any other provision of State law to the
18contrary, November 8, 2022 shall be a State holiday known as
192022 General Election Day and shall be observed throughout the
20State under this amendatory Act of the 102nd General Assembly.

23    Section 99. Effective date. This Act takes effect upon
24becoming law.
