SYNOPSIS AS INTRODUCED:
 
70 ILCS 805/8   from Ch. 96 1/2, par. 6315

    Amends the Downstate Forest Preserve District Act. Excepts the following types of contracts from competitive bidding requirements: professional or technical services, utilities, technology integration, printed matter, those not adapted to bidding, single source, repairs by the manufacturer or its agent, and emergency. Effective immediately.

1     AN ACT concerning forest preserve districts.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Downstate Forest Preserve District Act is
5 amended by changing Section 8 as follows:
 
6     (70 ILCS 805/8)  (from Ch. 96 1/2, par. 6315)
7     Sec. 8. Powers and duties of corporate authority and
8 officers; contracts; salaries.
9     (a) The board shall be the corporate authority of such
10 forest preserve district and shall have power to pass and
11 enforce all necessary ordinances, rules and regulations for the
12 management of the property and conduct of the business of such
13 district. The president of such board shall have power to
14 appoint such employees as may be necessary. In counties with
15 population of less than 3,000,000, within 60 days after their
16 selection the commissioners appointed under the provisions of
17 Section 3a of this Act shall organize by selecting from their
18 members a president, secretary, treasurer and such other
19 officers as are deemed necessary who shall hold office for the
20 fiscal year in which elected and until their successors are
21 selected and qualify. In the one district in existence on July
22 1, 1977, that is managed by an appointed board of
23 commissioners, the incumbent president and the other officers

1 appointed in the manner as originally prescribed in this Act
2 shall hold such offices until the completion of their
3 respective terms or in the case of the officers other than
4 president until their successors are appointed by said
5 president, but in all cases not to extend beyond January 1,
6 1980 and until their successors are selected and qualify.
7 Thereafter, the officers shall be selected in the manner as
8 prescribed in this Section except that their first term of
9 office shall not expire until June 30, 1981 and until their
10 successors are selected and qualify.
11     (b) In any county, city, village, incorporated town or
12 sanitary district where the corporate authorities act as the
13 governing body of a forest preserve district, the person
14 exercising the powers of the president of the board shall have
15 power to appoint a secretary and an assistant secretary and
16 treasurer and an assistant treasurer and such other officers
17 and such employees as may be necessary. The assistant secretary
18 and assistant treasurer shall perform the duties of the
19 secretary and treasurer, respectively in case of death of such
20 officers or when such officers are unable to perform the duties
21 of their respective offices.
22     (c) All contracts for supplies, material or work involving
23 an expenditure in excess of $20,000 shall be let to the lowest
24 responsible bidder, after advertising at least once in one or
25 more newspapers of general circulation within the district,
26 excepting (1) work requiring personal confidence; (2) work of

1 individuals possessing a high degree of professional or
2 technical skill where the ability or fitness of the individual
3 plays an important part; (3) contracts for utility service,
4 such as gas and electric; (4) contracts for services or
5 supplies that require integration with existing technology or
6 systems connected therewith, or with existing computer
7 hardware and software, such as security systems and integrated
8 computer and data systems and services related thereto; (5)
9 contracts for the purchase of magazines, books, periodicals,
10 and similar articles of an educational or instructional nature;
11 (6) contracts that by their nature are not adapted to award by
12 competitive bidding, such as telecommunication systems,
13 contracts for services or supplies that are available only from
14 a single source, and contracts of a proprietary nature; (7)
15 contracts for the maintenance or servicing of, or provision of
16 repair parts for, equipment that are made with the manufacturer
17 or authorized service agent of that equipment where the
18 provision of parts, maintenance, or servicing can best be
19 performed by the manufacturer or authorized service agent; (8)
20 contracts required to meet an immediate emergency affecting the
21 district or its property, or affecting the public health,
22 safety, or welfare, in which case the board of commissioners
23 shall set forth the nature of the danger to the district or to
24 the public health, safety, or welfare; and (9) or necessary
25 supplies under the control of monopolies, where competitive
26 bidding is impossible. Contracts for supplies, material or work

1 involving an expenditure of $20,000 or less may be let without
2 advertising for bids, but whenever practicable, at least 3
3 competitive bids shall be obtained before letting such
4 contract. All contracts for supplies, material or work shall be
5 signed by the president of the board of commissioners or by any
6 such other officer as the board in its discretion may
7 designate.
8     (d) (c) The president of any board of commissioners
9 appointed under the provisions of Section 3a of this Act shall
10 receive a salary not to exceed the sum of $2500 per annum and
11 the salary of other members of the board so appointed shall not
12 exceed $1500 per annum. Salaries of the commissioners, officers
13 and employees shall be fixed by ordinance.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
