SYNOPSIS AS INTRODUCED:
 
20 ILCS 1505/1505-200   was 20 ILCS 1505/43.21

    Amends the Department of Labor Law of the Civil Administrative Code of Illinois. Provides that the Department of Labor shall require that each State agency require an applicant for State employment to disclose to the State agency on an application for State employment criminal history record information of the applicant, including violations of traffic regulations governing the movement of vehicles, but excluding violations of traffic regulations not governing the movement of vehicles.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Labor Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 1505-200 as follows:
 
7     (20 ILCS 1505/1505-200)  (was 20 ILCS 1505/43.21)
8     Sec. 1505-200. Criminal history record information.
9     (a) Whenever the Department is authorized or required by
10 law to consider some aspect of criminal history record
11 information for the purpose of carrying out its statutory
12 powers and responsibilities, then, upon request and payment of
13 fees in conformance with the requirements of Section 2605-400
14 of the Department of State Police Law (20 ILCS 2605/2605-400),
15 the Department of State Police is authorized to furnish,
16 pursuant to positive identification, any information contained
17 in State files that is necessary to fulfill the request.
18     (b) The Department shall require that each State agency
19 require an applicant for State employment to disclose to the
20 State agency on an application for State employment criminal
21 history record information of the applicant, including
22 violations of traffic regulations governing the movement of
23 vehicles, but excluding violations of traffic regulations not

1 governing the movement of vehicles. For the purposes of this
2 subsection (b):
3         (1) "Application for State employment" means a written
4     or electronic form submitted by an applicant who is seeking
5     employment with a State agency.
6         (2) "State agency" has the meaning ascribed to it in
7     Section 1-7 of the Illinois State Auditing Act.
