SYNOPSIS AS INTRODUCED:

720 ILCS 570/405.4 new

Amends the Illinois Controlled Substances Act. Provides that a person who knows or should know that one or more specified controlled substance violations are being committed from, upon, or in residential property he or she owns, manages, or controls that has been physically altered to increase the number of living units therein in violation of any applicable building codes is guilty of a Class A misdemeanor and the residential property is subject to forfeiture. Effective immediately.

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Controlled Substances Act is amended by adding Section 405.4 as follows:

(720 ILCS 570/405.4 new)

Sec. 405.4. Controlled substance violations committed from, upon, or in residential property physically altered to increase the number of living units in violation of building codes. A person who knows or should know that one or more violations of Section 401, 402, or 407 of this Act are being committed from, upon, or in residential property he or she owns, manages, or controls that has been physically altered to increase the number of living units therein in violation of any applicable building codes is guilty of a Class A misdemeanor and the residential property is subject to forfeiture as described in Section 505 of this Act.

Section 99. Effective date. This Act takes effect upon becoming law.
