SYNOPSIS AS INTRODUCED:
 
20 ILCS 1305/10-65 new

    Amends the Department of Human Services Act. Provides that the Department of Human Services Division of Mental Health under the leadership of Secretary of the Department of Human Services and as the State Mental Health Authority, in an effort to develop and establish a comprehensive State mental health plan for Illinois and to coordinate all policy making in mental health, shall convene and lead a Work Group composed of directors of State agencies and principal stakeholders in the public mental health system. Provides that the Work Group is charged with designing Illinois' mental health system to be more efficient and effective as well as reduce redundancies in the delivery of services to persons with mental illnesses. Sets forth items that must be included in the Illinois Comprehensive State Mental Health Plan. Sets forth other Work Group functions.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Human Services Act is amended
5 by adding Section 10-65 as follows:
 
6     (20 ILCS 1305/10-65 new)
7     Sec. 10-65. Mental Health Work Group.
8     (a) The Department's Division of Mental Health under the
9 leadership of Secretary and as the State Mental Health
10 Authority, in an effort to develop and establish a
11 comprehensive State mental health plan for Illinois and to
12 coordinate the policy making in mental health, shall convene
13 and lead a Work Group composed of directors of State agencies
14 and principal stakeholders in the public mental health system,
15 including but not limited to:
16         (1) The Department of Human Services in the program
17     areas of Alcoholism and Substance Abuse, Community Health
18     and Prevention, Developmental Disabilities, Human Capital
19     Development, and Rehabilitation Services.
20         (2) The Department of Healthcare and Family Services.
21         (3) The Department of Corrections.
22         (4) The Department of Juvenile Justice.
23         (5) The Department of Children and Family Services.

1         (6) The Department of Public Health.
2         (7) The Department on Aging.
3         (8) The State Board of Education.
4     The Work Group shall also include representatives of other
5 agencies and commissions of State government, including:
6         (9) The Illinois Housing Authority.
7         (10) The Illinois Violence Prevention Authority.
8         (11) The Criminal Justice Information Authority.
9     The Work Group shall also include adult consumers of mental
10 health services and parents of youth with serious emotional
11 disturbance.
12     The Work Group shall also include clinical practitioners,
13 academics, advocacy groups, and other stakeholders as deemed
14 appropriate by the mental health authority.
15     (b) The Department's Division of Mental Health, as the
16 State Mental Health Authority, shall work with other State
17 agencies to develop mechanisms to share data maintained by any
18 State agency purchasing or providing mental health services as
19 permitted by law. This access is deemed necessary by the State
20 Mental Health Authority to report on the status of the mental
21 health service system in Illinois.
22     (c) The Work Group is charged with designing Illinois'
23 mental health system to be more efficient and effective as well
24 as reduce redundancies in the delivery of services to persons
25 with mental illnesses in the following ways:
26         (1) Conducting a thorough statewide needs assessment

1     and reporting on the current status of the mental health
2     system using data from all state agencies.
3         (2) Developing a comprehensive State mental health
4     plan.
5         (3) Identifying and recommending policy,
6     organizational, and financing changes required to
7     effectively carry out the State plan.
8         (4) Coordinating policy with other State agencies and
9     on all federal initiatives.
10         (5) Working with the Illinois Children's Mental Health
11     Partnership to incorporate a children's mental health plan
12     to ensure a comprehensive State mental health plan for all
13     ages.
14         (6) Establishing cross-departmental management teams
15     to address specific policy areas, address specific
16     transformation planning objectives, and implement and
17     monitor policy decisions. Specific focus shall be given to
18     cross-departmental management of the long-term care system
19     as the State moves to rebalancing resources and services
20     and maximizing resources in community-based settings to
21     ensure an appropriate level of services across a
22     comprehensive continuum of care.
23     (d) The Work Group shall coordinate its policy and planning
24 activities with other State-federal initiative planning and
25 leadership groups.
26     (e) The "Illinois Comprehensive State Mental Health Plan"

1 shall include but need not be limited to the following:
2         (1) A review and analysis of all laws, rules and
3     regulations, and programs and policies of the State of
4     Illinois and of the departments, commissions, boards,
5     agencies, and offices in the executive branch thereof,
6     which pertain to mental health care services and supports.
7     The analysis shall identify barriers to access and make
8     recommendations that will enable the residents of Illinois
9     who require assistance to access needed mental health care
10     services.
11         (2) The development of proposals for administrative
12     restructuring of existing and future programs, policies,
13     and procedures to improve the mental health care delivery
14     system, including non-medical services such as
15     transportation, housing, education, and vocational
16     assistance, that are necessary for recovery and productive
17     community-based living for persons with mental illnesses,
18     which are achievable within resources available to the
19     State.
20         (3) An analysis of programmatic, procedural, and
21     fiscal impacts of any current or proposed policies or
22     practices.
23         (4) Exploration of and recommendations as to methods to
24     secure sufficient funding and develop and manage
25     cross-agency (braided) funding to provide community-based
26     services for persons needing mental health care services.

1         (5) Recommendations on strategies to educate the
2     public regarding identification of mental health care
3     needs, effective treatments for mental illness, and
4     methods of accessing services.
5     (f) In conducting the assessment of the current system,
6 developing the Comprehensive State Mental Health Plan, and
7 executing other work of the group, the Work Group shall:
8         (1) Review all relevant work in progress or which has
9     been completed by State departments, various statewide
10     task forces, councils, commissions, and other bodies that
11     have convened to address related mental health care issues.
12         (2) Consider all existing studies, reports, and
13     settlement agreements related to the Illinois system of
14     mental health services and supports.
15         (3) Obtain input from a broad range of stakeholders,
16     including consumers, their family members, advocates, and
17     private providers of services.
18         (4) Use consultation from nationally recognized
19     experts and officials in other states in order to identify
20     promising or proven practices that are consumer-centered,
21     research-based, cost-effective, and applicable to
22     improving accessibility, capacity, quality, and financing
23     across all mental health care services and supports which
24     may be adaptable in Illinois.
25     (g) Upon submittal to the Governor and the General Assembly
26 of the Illinois Comprehensive State Mental Health Plan, the

1 Work Group shall continue to meet quarterly to review progress
2 in the implementation of the plan and shall revise the plan as
3 needed based on lessons learned, stakeholder input, and
4 advancements in best practices for the delivery of mental
5 health care services.
6     (h) All departments, commissions, boards, offices,
7 entities, agencies, and officers of the State of Illinois, or
8 any political subdivision thereof, are authorized and directed
9 to cooperate with the implementation of this amendatory Act of
10 the 96th General Assembly.
