SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/9-8.5 new

    Amends the Election Code. Limits the campaign expenditures of a candidate for State Senator or State Representative to $50,000 and $25,000, respectively. Applies the limit separately to the period before the general primary and the period between the primary and the general election.

1     AN ACT concerning elections.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Election Code is amended by adding Section
5 9-8.5 as follows:
 
6     (10 ILCS 5/9-8.5 new)
7     Sec. 9-8.5. General Assembly campaign expenditure limits.
8     (a) For the purposes of this Section:
9     "General election period" means the period beginning on the
10 day after the general primary election and ending at the
11 conclusion of the next general election day following that
12 primary.
13     "Primary period" means the period beginning on the first
14 day provided by this Code for filing nominating petitions for
15 the office of State Senator or State Representative and ending
16 at the conclusion of the general primary election day for which
17 those nominating petitions are filed.
18     (b) A candidate for the office of State Senator may not
19 make expenditures (i) in excess of $50,000 during the primary
20 period and (ii) in excess of $50,000 during the immediately
21 subsequent general election period. A candidate for the office
22 of State Representative may not make expenditures (i) in excess
23 of $25,000 during the primary period and (ii) in excess of

1 $25,000 during the immediately subsequent general election
2 period. Each limit specified in this subsection for a period is
3 the aggregate of all expenditures during that period (i) made
4 by the candidate, (ii) made by any political committee
5 organized or authorized to be organized by the candidate on
6 behalf of his or her candidacy for State Senator or State
7 Representative, and (iii) authorized by the candidate and made
8 on behalf of his or her candidacy for State Senator or State
9 Representative by any other person or entity. Each limit
10 specified in this subsection is the total allowed for that
11 period; a candidate whose expenditures during one period are
12 less than the limit for that period may not increase another
13 period's limit by that unexpended amount.
