SYNOPSIS AS INTRODUCED:
 
ILCON Art. IV, Sec. 14

    Proposes to amend the Legislature Article of the Illinois Constitution. Provides that an Executive or a Judicial officer may be impeached by the House of Representatives by the vote of three-fifths of the members elected (instead of a majority). Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to change Section 14 of Article
9 IV as follows:

13 SECTION 14. IMPEACHMENT
14     The House of Representatives has the sole power to conduct
15 legislative investigations to determine the existence of cause
16 for impeachment and, by the vote of three-fifths a majority of
17 the members elected, to impeach Executive and Judicial
18 officers. Impeachments shall be tried by the Senate. When
19 sitting for that purpose, Senators shall be upon oath, or
20 affirmation, to do justice according to law. If the Governor is
21 tried, the Chief Justice of the Supreme Court shall preside. No
22 person shall be convicted without the concurrence of two-thirds
23 of the Senators elected. Judgment shall not extend beyond

1 removal from office and disqualification to hold any public
2 office of this State. An impeached officer, whether convicted
3 or acquitted, shall be liable to prosecution, trial, judgment
4 and punishment according to law.

SCHEDULE
7     This Constitutional Amendment takes effect upon being
8 declared adopted in accordance with Section 7 of the Illinois
9 Constitutional Amendment Act.
