1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 1-148.3a-5 and 11-1414.1 as follows:

9     Sec. 1-148.3a-5. Multifunction school activity bus. A
10 multifunction school-activity bus (MFSAB) means a school bus
11 manufactured for the purpose of transporting 11 to 15 persons,
12 including the driver, whose purposes do not include
13 transporting students to and from home or school bus stops.
14 However, non-public schools may use a multifunction school
15 activity bus to transport non-public school students between
16 non-public schools for curriculum-related school activity. A
17 MFSAB is prohibited from meeting the special requirements for
18 school buses in Sections 12-801, 12-803, and 12-805 and
19 subsection (a) of Section 12-802 of this Code.

1     Sec. 11-1414.1. School transportation of students.
2     (a) Every student enrolled in grade 12 or below in any
3 entity listed in subsection (a) of Section 1-182 of this Code
4 must be transported in a school bus or a vehicle described in
5 subdivision (1)or (2)of subsection (b) of Section 1-182 of this
6 Code for any curriculum-related school activity. However,
7 non-public schools may use a multifunction school activity bus,
8 as defined in Section 1-148.3a-5 of this Code, to transport
9 non-public school students between non-public schools for
10 curriculum-related school activity. "Curriculum-related school
11 activity" as used in this subsection (a) includes
12 transportation from home to school or from school to home,
13 tripper or shuttle service between school attendance centers,
14 transportation to a vocational or career center or other
15 trade-skill development site or a regional safe school or other
16 school-sponsored alternative learning program, or a trip that
17 is directly related to the regular curriculum of a student for
18 which he or she earns credit.
19     (b) Every student enrolled in grade 12 or below in any
20 entity listed in subsection (a) of Section 1-182 of this Code
21 who is transported in a vehicle that is being operated by or
22 for a public or private primary or secondary school, including
23 any primary or secondary school operated by a religious
24 institution, for an interscholastic, interscholastic-athletic,
25 or school-sponsored, noncurriculum-related activity that (i)
26 does not require student participation as part of the

1 educational services of the entity and (ii) is not associated
2 with the students' regular class-for-credit schedule shall
3 transport students only in a school bus or vehicle described in
4 subsection (b) of Section 1-182 of this Code. This subsection
5 (b) does not apply to any second division vehicle used by an
6 entity listed in subsection (a) of Section 1-182 of this Code
7 for a parade, homecoming, or a similar noncurriculum-related
8 school activity.

10     Section 99. Effective date. This Act takes effect July 1,
11 2010.
