SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/16-163   from Ch. 108 1/2, par. 16-163
40 ILCS 5/16-164   from Ch. 108 1/2, par. 16-164

    Amends the Downstate Teacher Article of the Pension Code. Changes the membership of the board of trustees from 13 to 11. Provides that the Governor shall appoint 4 members (instead of 6 members). Makes changes in the provisions concerning terms of office for the appointed members. Terminates the terms of members of the Board who are appointed by the Governor, including temporary appointees, on the effective date of the amendatory Act and removes language that would allow the current members to hold over in office for 60 days.

1     AN ACT concerning public employee benefits.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Pension Code is amended by changing
5 Sections 16-163 and 16-164 as follows:
 
6     (40 ILCS 5/16-163)  (from Ch. 108 1/2, par. 16-163)
7     Sec. 16-163. Board created. A board of 11 13 members
8 constitutes the board of trustees authorized to carry out the
9 provisions of this Article and is responsible for the general
10 administration of the System. The board shall be known as the
11 Board of Trustees of the Teachers' Retirement System of the
12 State of Illinois. The board shall be composed of the
13 Superintendent of Education, ex officio, who shall be the
14 president of the board; 4 6 persons, not members of the System,
15 to be appointed by the Governor, who shall hold no elected
16 State office; 4 persons who, at the time of their election, are
17 teachers as defined in Section 16-106, elected by the
18 contributing members; and 2 annuitant members elected by the
19 annuitants of the System, as provided in Section 16-165.

22     Sec. 16-164. Board - appointed members - vacancies. Terms

1 of office for the appointed members shall begin on July 15 of
2 an even-numbered year, except that the terms of office for
3 members appointed pursuant to this amendatory Act of the 96th
4 General Assembly this amendatory Act of the 96th General
5 Assembly shall begin upon being confirmed by the Senate. The
6 Governor shall appoint 2 3 members as trustees with the advice
7 and consent of the Senate in each even-numbered year who shall
8 hold office for a term of 4 years, except that, of the members
9 appointed pursuant to this amendatory Act of the 96th General
10 Assembly this amendatory Act of the 96th General Assembly, 2 3
11 members shall be appointed for a term ending July 14, 2012 and
12 2 3 members shall be appointed for a term ending July 14, 2014.
13 Each such appointee shall reside in and be a taxpayer in the
14 territory covered by this system, shall be interested in public
15 school welfare, and experienced and competent in financial and
16 business management. A vacancy in the term of an appointed
17 trustee shall be filled for the unexpired term by appointment
18 of the Governor.
19     Notwithstanding any provision of this Section to the
20 contrary, the term of office of each member of the Board
21 appointed by the Governor, including any temporary
22 appointment, who is sitting on the Board on the effective date
23 of this amendatory Act of the 96th General Assembly this
24 amendatory Act of the 96th General Assembly is terminated on
25 that effective date. A trustee sitting on the Board on the
26 effective date of this amendatory Act of the 96th General

1 Assembly shall this amendatory Act of the 96th General Assembly
2 may not hold over in office for more than 60 days after the
3 effective date of this amendatory Act of the 96th General
4 Assembly. Nothing in this Section shall prevent the Governor
5 from making a temporary appointment or nominating a trustee
6 holding office on the day before the effective date of this
7 amendatory Act of the 96th General Assembly this amendatory Act
8 of the 96th General Assembly.
