SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/3.1-15-45 new

    Amends the Illinois Municipal Code. Provides that if petitions for nomination to be elected to an office have been filed for the same person for 2 or more offices that are incompatible, that person must withdraw as a candidate for all but one of those offices within the 5 business days following the last day for petition filing. If that person fails to withdraw as a candidate within that time, the person's name shall not be certified, nor printed on the ballot, for any office.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 3.1-15-45 as follows:
 
6    (65 ILCS 5/3.1-15-45 new)
7    Sec. 3.1-15-45. Petitions for incompatible offices.
8Notwithstanding any other provision of law, if petitions for
9nomination have been filed for the same person for 2 or more
10offices to be elected under this Code that are incompatible so
11that the same person could not serve in more than one of those
12offices if elected, that person must withdraw as a candidate
13for all but one of those offices within the 5 business days
14following the last day for petition filing. If the person fails
15to withdraw as a candidate for all but one of the offices
16within that time, the person's name shall not be certified, nor
17printed upon the ballot, for any office.
