SYNOPSIS AS INTRODUCED:

65 ILCS 5/3.1-15-45 new

Amends the Illinois Municipal Code. Provides that if petitions for nomination to be elected to an office have been filed for the same person for 2 or more offices that are incompatible, that person must withdraw as a candidate for all but one of those offices within the 5 business days following the last day for petition filing. If that person fails to withdraw as a candidate within that time, the person's name shall not be certified, nor printed on the ballot, for any office.

A BILL FOR

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 3.1-15-45 as follows:

Sec. 3.1-15-45. Petitions for incompatible offices. Notwithstanding any other provision of law, if petitions for nomination have been filed for the same person for 2 or more offices to be elected under this Code that are incompatible so that the same person could not serve in more than one of those offices if elected, that person must withdraw as a candidate for all but one of those offices within the 5 business days following the last day for petition filing. If the person fails to withdraw as a candidate for all but one of the offices within that time, the person's name shall not be certified, nor printed upon the ballot, for any office.
