SYNOPSIS AS INTRODUCED:

    Amends the School Code. Provides that, beginning on July 1, 2011, no scholarships may be awarded under provisions that permit members of the General Assembly to award scholarships to persons for attendance at a State sponsored university. A scholarship awarded before July 1, 2011 is valid until its stated term expires, but may not be renewed. Effective July 1, 2011.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Sections
530-9, 30-10, and 30-11 as follows:
 
6    (105 ILCS 5/30-9)  (from Ch. 122, par. 30-9)
7    Sec. 30-9. General Assembly scholarship; conditions of
8admission; award by competitive examination.
9    Each member of the General Assembly may nominate annually 2
10persons of school age and otherwise eligible, from his
11district; each shall receive a certificate of scholarship in
12any State supported university designated by the member. Any
13member of the General Assembly in making nominations under this
14Section may designate that his nominee be granted a 4 year
15scholarship or may instead designate 2 or 4 nominees for that
16particular scholarship, each to receive a 2 year or a one year
17scholarship, respectively. The nominee, if a graduate of a
18school accredited by the University to which nominated, shall
19be admitted to the university on the same conditions as to
20educational qualifications as are other graduates of
21accredited schools. If the nominee is not a graduate of a
22school accredited by the university to which nominated, he
23must, before being entitled to the benefits of the scholarship,

1pass an examination given by the superintendent of schools of
2the county where he resides at the time stated in Section 30-7
3for the competitive examination. The president of each
4university shall prescribe the rules governing the examination
5for scholarship to his university.
6    A member of the General Assembly may award the scholarship
7by competitive examination conducted under like rules as
8prescribed in Section 30-7 even though one or more of the
9applicants are graduates of schools accredited by the
10university.
11    A member of the General Assembly may delegate to the
12Illinois Student Assistance Commission the authority to
13nominate persons for General Assembly scholarships which that
14member would otherwise be entitled to award, or may direct the
15Commission to evaluate and make recommendations to the member
16concerning candidates for such scholarships. In the event a
17member delegates his nominating authority or directs the
18Commission to evaluate and make recommendations concerning
19candidates for General Assembly scholarships, the member shall
20inform the Commission in writing of the criteria which he
21wishes the Commission to apply in nominating or recommending
22candidates. Those criteria may include some or all of the
23criteria provided in Section 25 of the Higher Education Student
24Assistance Act. A delegation of authority under this paragraph
25may be revoked at any time by the member.
26    Failure of a member of the General Assembly to make a

1nomination in any year shall not cause that scholarship to
2lapse, but the member may make a nomination for such
3scholarship at any time thereafter before the expiration of his
4term, and the person so nominated shall be entitled to the same
5benefits as holders of other scholarships provided herein. Any
6such scholarship for which a member has made no nomination
7prior to the expiration of the term for which he was elected
8shall lapse upon the expiration of that term.
9    Beginning on July 1, 2011, no scholarships may be awarded
10under this Section. However, a scholarship awarded under this
11Section before July 1, 2011 is valid until its stated term
12expires, but may not be renewed.

15    Sec. 30-10. Filing nominations-Failure to accept or
16pass-Second nomination.
17    Nominations, under Section 30-9, showing the name and
18address of the nominee, and the term of the scholarship,
19whether 4 years, 2 years or one year, must be filed with the
20State Superintendent of Education not later than the opening
21day of the semester or term with which the scholarship is to
22become effective. The State Superintendent of Education shall
23forthwith notify the president of the university of such
24nomination.
25    If the nominee fails to accept the nomination or, not being

1a graduate of a school accredited by the university, fails to
2pass the examination for admission, the president of the
3university shall at once notify the State Superintendent of
4Education. Upon receiving such notification, the State
5Superintendent of Education shall notify the nominating
6member, who may name another person for the scholarship. The
7second nomination must be received by the State Superintendent
8of Education not later than the middle of the semester or term
9with which the scholarship was to have become effective under
10the original nomination in order to become effective as of the
11opening date of such semester or term otherwise it shall not
12become effective until the beginning of the next semester or
13term following the making of the second nomination. Upon
14receiving such notification, the State Superintendent of
15Education shall notify the president of the university of such
16second nomination. If any person nominated after the effective
17date of this amendatory Act of 1973 to receive a General
18Assembly scholarship changes his residence to a location
19outside of the district from which he was nominated, his
20nominating member may terminate that scholarship at the
21conclusion of the college year in which he is then enrolled.
22For purposes of this paragraph, a person changes his residence
23if he registers to vote in a location outside of the district
24from which he was nominated, but does not change his residence
25merely by taking off-campus housing or living in a
26nonuniversity residence.

7    Sec. 30-11. Failure to use scholarship - Further
8nominations.
9    If any nominee under Section 30-9 or 30-10 discontinues his
10course of instruction or fails to use the scholarship, leaving
111, 2, 3, or 4 years thereof unused, the member of the General
12Assembly may, except as otherwise provided in this Article,
13nominate some other person eligible under this Article from his
14district who shall be entitled to the scholarship for the
15unexpired period thereof. Such appointment to an unexpired
16scholarship vacated before July 1, 1961, may be made only by
17the member of the General Assembly who made the original
18appointment and during the time he is such a member. If a
19scholarship is vacated on or after July 1, 1961, and the member
20of the General Assembly who made the original appointment has
21ceased to be a member, some eligible person may be nominated in
22the following manner to fill the vacancy: If the original
23appointment was made by a Senator, such nomination shall be
24made by the Senator from the same district; if the original
25appointment was made by a Representative, such nomination shall

1be made by the Representative from the same district. Every
2nomination to fill a vacancy must be accompanied either by a
3release of the original nominee or if he is dead then an
4affidavit to that effect by some competent person. The failure
5of a nominee to register at the university within 20 days after
6the opening of any semester or term shall be deemed a release
7by him of the nomination, unless he has been granted a leave of
8absence in accordance with Section 30-14 or unless his absence
9is by reason of his entry into the military service of the
10United States. The university shall immediately upon the
11expiration of 20 days after the beginning of the semester or
12term notify the State Board of Education as to the status of
13each scholarship, who shall forthwith notify the nominating
14member of any nominee's failure to register or, if the
15nominating member has ceased to be a member of the General
16Assembly, shall notify the member or members entitled to make
17the nomination to fill the vacancy. All nominations to unused
18or unexpired scholarships shall be effective as of the opening
19of the semester or term of the university during which they are
20made if they are filed with the university during the first
21half of the semester or term, otherwise they shall not be
22effective until the opening of the next following semester or
23term.
24    Beginning on July 1, 2011, no scholarships may be awarded
25under this Section. However, a scholarship awarded under this
26Section before July 1, 2011 is valid until its stated term

3    Section 99. Effective date. This Act takes effect July 1,
42011.
