1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1035.3 as follows:
 
6    (55 ILCS 5/5-1035.3 new)
7    Sec. 5-1035.3. Tax increase opt out.
8    (a) A county, by ordinance or resolution adopted by the
9county board or by referendum, may opt out of any tax increase
10imposed pursuant to Section 4.03 of the Regional Transportation
11Authority Act, as amended by Public Act 95-708, and to be used
12by the county as provided in Section 4.03.3 of that Act. If a
13county opts out of a tax increase, then the tax increase shall
14no longer be imposed or collected in the county and the county
15shall no longer receive distributions or any other benefits
16derived from the imposition of the tax increase.
17    (b) The county board, by resolution, may provide for the
18submission to the electors the question of whether the county
19shall opt out of a tax increase. The board shall certify the
20resolution and proposition to the proper election officials,
21who shall submit the question to the electors at the
22consolidated or general election next occurring and in
23accordance with the general election law. The proposition shall

1be in substantially the following form:
2        Shall the County of (insert name of county) opt out of
3    (insert description of tax increase)?
4    The votes shall be recorded as "Yes" or "No".
5    If a majority of the electors voting on the proposition
6vote in favor of it, then the county has opted out of the tax
7increase.
8    (c) A county may not opt out of any tax increase under this
9Section if the proceeds are pledged to make principal or
10interest payments on bonds or other long-term debt.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
